Hi all,

so at the start of April I reversed into a parked car. I rent a cottage on a country estate and it's a mile to house within the estate.

I reported the accident to my insurance as didn't have a pen and paper in the car so went home to get some and came back and car had gone. there were no witnesses at the time to report the accident to either hence reported it to my insurance.

insurance company never got a claim back till December stating what damage had occurred.

iv now been summoned to court for failing to report a accident (granted I genuinely didn't realise unless someone was injured it had to go to the police) , driving without due car And attention and failure to stop after accident.

iv had a clean license for over 20 years. I hold my hands up to hitting the car hence why I went through insurance. when the police sent a form asking if there had been a accident I said there had but no damage reported and in hands of insurance company which was the case as nothing was claimed for 4 months.

what is the likely outcome of my pending court case as I say no points or speeding offences clean license. I admit I hit the car and didn't report it to the police but was reported to insurance.

a witness supposedly did witness it but never got out her car and the car park was dark at the time.

as I say I hold my hands up am guilty hit the car and was with the insurance company. which the insurance company has now settled the claim with there car repaired.

The police don't have be notified if it a non-injury accident AND details are exchanged at the scene. It seems the latter didn't happen. Usually the police will not prosecute if insurance companies are engaged, so this seems unusual.

I hold my hands up details were not exchanged as no one was around. by the time I replied with a note car had left the car park. It was reported to my insurance company and claim has been settled as of this week.
police sent out a S.172 form to which I wrote on it that reported to insurance company and no claim made as there was no damage to my car and the claimant hadn't put a claim in at that stage for damage. my insurance company even said they belief they are just following formalities, 4 months later they make there claim.

never had points but sadly this seems like it will be happening if not worst case I get a ban even though I admitted liability with insurance.

I also can't contact the police to notify them that a claim has been settled.

If you fail to provide your details at the scene, the obligation is to report it to the police within 24 hours (as as soon as reasonably practicable). The idea is that the victim is able to obtain the details of the person he might want to claim against without having to play detective.

Anything that happened after the offence of failing to stop or report was committed has no bearing on the commission of the offence. Neither does what may happen in many other cases.
