Hi.

I have been flashed on the M1 going under a red X closed lane past a camera. Thing is, I couldn't safely move out in time. When joining the motorway, I wasn't going to dash across two lanes so I joined, then when I wanted to move again, there was a car on my right so couldn't. The car got next to me right before the red X (speed limit was 40) and I slowed to 30 to move out but I did this after I passed the X. Then right as I started moving out of my lane, I got flashed. I also saw many other flashes in my rear view mirror so likely others got cought out doing the same thing. I have now received my options: Motorway Awareness course or £100 fine and 3 points. Thing is, I don't feel it's right. I want to contest it but I want advice if I should or if I should just let it go and do the course. It feels unjust. I did what I deemed safely possible at the time and I slowed down too but I couldn't be expected to slam the brakes on the motorway to not pass under the X. Also, I already started moving out of the lane plus there was no obstruction ever in that closed lane.

EDIT: My dashcam date is wrong, it's definitely recent.

A red X means that you must not proceed past that point in that lane, not that you really ought to make some half-arsed effort to try to get out of the lane before that point, but if that doesn't work at least you made an effort.

You decided that moving across as soon as you joined the motorway wasn't for you, and slowing down to 30mph didn't enable you to change lanes before the X. If you had indicated, it might have prompted the driver in lane 3 to move over, or you could (and should) have slowed down further to slot in behind him before the X if there was no better way. The video shows a seemingly almost empty motorway.

i cant see you have any argument there.
you had plenty of time to get in lane before the highly visible gantry. the fact there was at the time you passed, no obstruction in lane 2 is totally irrelevant.

There was a warning board that indicated lanes 3 and 4 were closed almost as soon as you joined the motorway (at about 0:25secs into the clip). That, together with the reasons above, makes me think you'd struggle with this.

You passed warning signs at 0:03, 0:28, and 0:40. The flashing red X was visible the entire time.

Imagine that instead of a red X sign, the lane was blocked by a brick wall. Would you driven straight towards it for 45 seconds, then smashed into it at 30mph?
