Hoping this community can help me.

Have received 2 separate Parking Charge Notices which appear to be for the same venue (the postcodes match but there are 2 different road names and the timings are not an exact match)

Upon entering the residential area, the driver attempted parking in one area but then decided to park in another area thinking it was a little closer to the residential address they were visiting to collect a second hand item from a resident not known to them as agreed through gumtree.

It was around 8pm with no obvious signage upon entering the area. Once inside the area it was all very poorly lit.

Please see attachments of PCN's with personal details redacted. Also note that the pictures used as evidence by CPM are extremely poor quality and reflect the poor lighting within the area. The pictures do not prove any contravention in my opinion as they barely show that they even contain a car, but not sure if this is of any relevance to the case.

I am yet to formalise any response but will have to send something in the next couple of days as approaching 28 day deadline.

I am the registered keeper of the vehicle.

This is bizarre. At face value, the 2 notices provide evidence against each other - the same vehicle cannot have been parked in contravention at 2 different car parks at the same time.

I'd be tempted to draft up 2 appeals (1 for each PCN), as the keeper, referring to the other.

Dear Sirs

I have received your parking notice _______ for vehicle registration mark ____ ___, in which you alleged that the driver has incurred a parking charge. I dispute this charge as the registered keeper - there is no obligation for me to identify the driver and I will not be doing so.

It is clear that there is an issue with your ANPR systems and/or quality control processes that means the charge cannot be upheld, and that you cannot prove the alleged contravention. Your PCN and ANPR images claim that the vehicle entered the car park at 20:22 on 22nd December 2025. The other parking charge you have issued (PCN reference ________) claims that the same vehicle entered a different car park at exactly the same time.

PCN ________

  • Alleged location: Copperhouse Green, Zone 1, Lowfield St
  • Alleged entry time: 20:22 - 22/12/25
  • Alleged departure time: 20:42 - 22/12/25

PCN ______

  • Alleged location: Copperhouse Green, Zone 3, Dartford
  • Alleged entry time: 20:22 - 22/12/25
  • Alleged departure time: 20:43 - 22/12/25

It is clearly impossible for the vehicle to have been simultaneously parked in 2 different locations at exactly the same time, and this discrepancy demonstrates an obvious issue with the enforcement mechanisms deployed at the site. Accordingly, you have no reliable evidence to demonstrate that the vehicle was parked at the alleged location at the alleged time, and you should cancel the charge, and conduct an investigation into the issues that led to this charge being incorrectly issued.

There's an example of the sort of wording you could use. As you've got 2 PCNs, you'll need to submit 2 appeals, but you can use the same wording, substituting the relevant PCN number etc. as needed. Depending on their response, I'd also be minded to escalate complaints about their accessing your data, when a manual check would have confirmed a clear issue.[/i]

At UK CPM we consider all appeals on a case-by-case basis. We take each appeal very seriously and thoroughly investigate any evidence that has been provided. We appreciate your circumstances and understand this is not a situation anyone would like to find themselves in; however, these parking conditions have been put in place to ensure fair usage for all motorists and support the needs of our client. After careful consideration, it is unfortunate that I am writing to you today to advise that on this occasion, your appeal has been unsuccessful.
 

The decision to uphold your parking charge notice has been made on the following basis.


Whilst we note the comments and reason for appeal, we can confirm that the vehicle remained on site for 20 minutes with no permit to authorise your stay. We must advise that this car park is run by Automatic Number Plate Recognition (ANPR) cameras which take a time and date stamped image of the vehicle on entry and exit, measuring the length of time the vehicle remained on site, this information is then cross-referenced with the data from the permit systems. Due to no permit being found, we can confirm that this PCN has been issued correctly.     


Either due to the reason for issue and/or the insufficient evidence provided to support the details of your appeal, we have considered this PCN and found that it does not fall under the category of Annex F the Appeals Charter of the Single Code of Practice. Therefore, if no further evidence is provided, we will deem this to be our final decision.


You have now reached the end of our internal appeals procedure and therefore you now have two options; either pay or appeal to the Independent Appeals Service (IAS) - you cannot do both.


To make payment of the total amount due as shown above, please use one of the following payment options;

In the event that your IAS appeal is unsuccessful, the full amount for the PCN will then be payable. If you lodge an appeal with the IAS and then subsequently pay the charge prior to that appeal being determined, then the appeal will be withdrawn, and you will not be given a further opportunity to contest the charge.


If you do not wish to dispute the matter further and payment is not received within 28 days of the date of this correspondence then additional charges may be incurred, for which you may be liable. If the charge continues to remain outstanding, the matter may be later referred for litigation in the County Court which could result in a County Court Judgment being made against you; this may impact on your ability to obtain credit in the future.

For clarity, which has been upheld and which has been rejected?

I am the registered keeper of the vehicle in question. I am appealing this Parking Charge Notice on the grounds that your Notice to Keeper does not comply with the mandatory requirements of Schedule 4 of the Protection of Freedoms Act 2012 (POFA).

Specifically, your Notice fails to meet the requirements of Paragraph 9(2)(e), which states that a Notice to Keeper must invite the keeper to pay the unpaid parking charge or provide the name and address of the driver. Your Notice contains no such invitation.

Because this statutory requirement has not been met, you cannot transfer liability from the driver to the keeper. As you have failed to establish keeper liability under POFA, I, as Registered Keeper, am under no obligation to pay this charge.

Please confirm cancellation of this charge.

@Brenda_R2 , whilst that might be suitable for an initial appeal, the OP is now at the IAS stage. They'll never go for the 9(2)(e) point, so he might as well try the more meritorious angle of their clearly unreliable ANPR system.

PCN 70198202 was upheld
PCN 70198466 was rejected

Don't rush to submit anything, I'll take a proper look when I've a little more time.

In the meantime, do you have any photos or maps showing the layout of this site so that we can try to understand what has happened?

If you know, do you know which of the 'zones' on the 2 PCNs the vehicle was actually parked in?

The driver has looked online to see if they can find any maps of the site but had no joy. They also looked at the street view images but they seem to be old from what the driver recollects of the area.
The driver is not familiar with the area and hasn't driven back there as its around 40mins away, but can drive back and get those details if you think it'll be useful?
