Received PCN for car on the Disable Bay, NSGL, Lulworth

Hi Ftla,

I received a PCN saying that the car was parked in a disable bay area however the pictures doesn't show that my car (with reg) was actually parked in the disable bay area. What should I do? link to the images

Bus driving since 1973. My advice, if you have a PSV licence, destroy it when you get to 65 or you'll be forever in demand.

Whose car is the one in the photos? There is one photo showing a car of the same colour parked in front of a fence with a disabled sign on it:

There could be other cars with the same colour. But the photo doesn't suggest it's my car. My car has the same colour. Should I appeal based on this? What should I email?

Was it your car?

If it was, simply saying "prove it was my car" won't get you far - for it to be someone else's, the operative would have had to take a photo of your vehicle at 18:34:49, run over to another vehicle and take a photo of that just 10 seconds later, then run back to your car to snap a further picture some 15 seconds later. That simply doesn't sound at all credible.

If you are prepared to fight this all the way (potentially to court), there's an argument to be made that they have not proved the vehicle was there beyond the relevant consideration period.

Yes it's my car. Thanks for the info. I've paid the parking fine now. I thought I could deflect based on the photos. Thanks for the advice. Much appreciated

But it wasn't a "fine"! It was simply a speculative invoice for an alleged breach of contract by the driver. What a waste of money. You din't have to pay anything.

Only the driver could have been liable for that contractual invoice and they had absolutely no idea who the driver was. You. as the Keeper, are under no legal obligation to identify the driver. Without the identity of the driver, they had nowhere to go with this as their 'invoice' did not comply with all the requirements of PoFA and so they were unable too transfer liability from the unknown driver to you, the known Keeper.
