Hello,

As post suggests, DCBL have sent a Notice of Debt Recovery letter for £170. Date of contravention is 11/02/2022, almost 3 years ago.

A couple of points which may or may not be relevant:

- I was not made aware of this contravention until yesterday, 17/12/24, when this notice arrived.

- I no longer own this vehicle.
- I moved address twice since the date of the alleged contravention.

- At the time, I was on sick leave from work (from roughly mid-December '21 to end of February '22). With Post Concussion Syndrome, and so was definitely not driving . While there is another who had driven that vehicle on some occasions, it is obviously too long ago to remember anything.

The letter states that I have lost my right to appeal. It would be impossible to prove the lack of any earlier notice of this alleged contravention (which, from what I've read, would invalidate it altogether), so, am I forced to engage DCBL, even if just to argue the above points?

Apologies for replying to my own post so soon.

After reading through other posts (specifically that raised by AnonymousMD) I have seen the following reply to AnonymousMD's post by b789,

'The way you fight this is to ignore everything that comes your way. They will not litigate in Scotland.

They are sending you debt collector letters which are designed to make the low-hanging fruit on the gullible tree capitulate and pay up out of fear and ignorance. Ignore the useless debt collector letters. Use them as kindling or to line the bottom of a cat litter tray.

Nothing is going to happen. Eventually they will stop. UKPC will not take you to court in Scotland.'

As this situation is similar enough to my own, I will follow the advice pasted above unless anyone thinks best to do otherwise.

Thankfully, I was already fully prepared to ignore these letters.

Correct. There is no Keeper liability in Scotland (for now).

The operator has no idea who the driver was unless you, the Keeper, tell them. Why you would do that when there is no legal obligation to to identify the driver to an unregulated private parking company, could only be down to ignorance of your rights or inadvertently doing so unintentionally.

As for DCBL, they are powerless and useless. They are not a party to the contract allegedly breached by the driver. They can huff and puff all they like but they are powerless to do anything about it.

ECP will not initiate litigation ion Scotland because they don't have jurisdiction there and even if they tried, it would be prohibitively expensive for them and well in excess of anything they would likely be able to recover. They may be thieving scammers but they are not stupid. They rely on the low-hanging fruit on the gullible tree to pay up out of ignorance.

Ignore them and especially the debt collector letters. They will eventually give up and go looking for lower-hanging fruit to pick.
