OPS NtK
« on: »
Hey.

I previously posted following reception of a paper PCN on my windscreen from One Parking Solution. The advice was to await a NtK which i have now received.

The parking spaces are for a residential flat block where my partner lives and i was parked within one of the marked visitors bays with a guest permit (allows for 12h parking session). I've asked to see if there was anywhere she could get it waivered as a resident, but she's tried before and it's not worked.

The alleged breach is that the vehicle has overstayed (max 12 hours) / returned within 24 hours.

I've attached a copy of the PCN, images from both dates (24H apart), signage & the NtK.

You can see on the images from each date that the vehicle had moved between the time the images were taken based on its position in the bays. Previous advice was to argue that the vehicle had been driven & parked by seperate drivers, as the vehicle itself cannot be held to contract. Would this still be the best way for me to respond?

Any advice appreciated!
