Why would you pay it before a hearing? Even if you were to lose, you would pay less than the claim amount as the court would not allow the fake added £70.

You are thinking along the lines of all the low-hanging fruit on the gullible tree that these vermin hope for. There is ZERO chance of you getting a CCJ or anything on your credit record.

Just because there may be a claim made against you, that has no effect on your credit rating. The only way it could affect your credit rating is if you lost and didn't pay the judgment amount within 28 days of the CCJ. If it's paid in full within 28 days, there is no record. It is completely expunged.

We would never advise you to do anything that could risk a CCJ on your credit record.

Thanks for that, I just don't know how it all works.
Is there a chance that this won't come to court?, i have read lots of other messages on here and get the impression with this defence i'm about to send, there is a good chance it won't come to court? Is this right? Or will it come to court regardless and my defence will just help in me winning the case?
I'm just worried as i have no idea how to defend myself as i dont really understand what any of the defence means  :-\

The vast majority of DCB 'Legal' claims are discontinued before court, as was mine from earlier this year.  The chances of you actually going to court are minuscule.

Happy to send you a copy of the DCB discontinuance letter from my case if it's any comfort.

It will result in a court claim being issued. However, there will be no court hearing. They discontinue all claims that are defended.

They rely on you being petrified about the litigation process and caving under the fear and ignorance of the process. They will discontinue once they have to pay the trial fee around a month before the hearing date.

Once they realise that you are not one of the low-hanging fruit on the gullible tree that gives up out of ignorance and pays, they move on to the many thousands of others who are not receiving advice here to pluck from the gullible tree.

In over 99% of these cases, the claim is either discontinued, struck out or, in the tiny number of more complex ones, end up being won in court. There is nothing unusual or complex about your case. It will end up as a discontinuation.

All part of the process. You have received a copy of the claimants N180 DQ. You will receive your own through the post from the CNBC.

Having received your own N180, do not use the paper form. Ignore all the other forms that came with it. You can discard those. Download your N180 own here and fill it in on your computer. You sign it by simply typing your full name in the signature box.

https://assets.publishing.service.gov.uk/media/673341e779e9143625613543/N180_1124.pdf

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question
."

• F1: Whichever is your nearest county court. Use this to find it:
Tell us if you know the court or tribunal name or address to find a court or tribunal in England or Wales
find-court-tribunal.service.gov.uk

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.

So grateful for your reply thank you. Good to know this is part of the process I thought they are just making an example of me. I’ll do exactly what you have advised. So I’ll wait for mine in the post then download the one from the link. Thanks again much appreciated

You can download it any time and fill it in ready to send as advised. If you check your MCOL history, it will update when they have sent your DQ. As soon as you see that in the MCOL history, you can then send yours without having to wait for the physical DQ to arrive in the post.

The next stage in the process will be a notice of allocation to your local county court. Let us know when you receive that.

Hi. I’ve received an email with a date for my mediation call. It says I need to explain my claim or defence to them which I don’t know what to say for my defence really pls can someone give me some tips ? It’s mandatory it says so I have to do this but I have no idea what to say. I thought the next thing I would receive is the court options. Thanks so much

Mediation is now a mandatory part of all these claims, but is usually pointless in these cases.

You need to turn up, but there's no obligation for you to get into a protracted debate about the merits of your case, or to offer them anything at all. Simply state that you are confident in the substance of your defence, that you do not believe you owe the claimant any money, and accordingly you are not prepared to offer them anything.

Do that and the call should be over very quickly. Offer nothing, and don't feel compelled to answer any question you don't wish to.

Thank you very much. Is there anything they might ask me that I won’t know what to say. Eg what is my defence? Shall I mention my disabled mother who I took to Specsavers or do I just stick to the fact that the date issued on fine is same date as I parked therefore that date wasn’t true. I’m sure that’s what I read on here somewhere as the issue date was the same. Just not sure if they say what’s your defence what to actually say. Many thanks

None of those things are mentioned in your defence, so no. Don't provide them any additional information other than what is in your defence.

"A copy has been provided to the claimant. For the reasons I have outlined in that defence I do not believe I owe the claimant anything. I'm not prepared to make any offer to settle"

For example.

The mediation call is not part of the judicial process. There is no judge or solicitors involved. You are not obliged to give them any information about your defence. The claimant has a copy of the defence and that is it.

You simply say that you only prepared to offer £0. Nothing else. Don’t enter into any discussion about anything else. The mediator is not a legally trained person and cannot offer an opinion on any outcome. If they do, tell them that they will be reported for making an uninformed opinion on legal matters that they are not qualified to make and you will be making a formal complaint about it.
