Parking Charge Notice - CPM - Amazon Flex

Hi,

The driver was completing a shift for Amazon flex using private vehicle on self employed basis and had to deliver multiple parcels to 3 separate buildings within the complex. Shift was on the 13th march at 15:21 and PCN issued 27th March to registered keeper. Driver parked next to the building where first delivery was to be done. Parked on no visible yellow lines, not in marked bays as they are usually reserved and not blocking any vehicles. Hazard lights put on and has poster on the dash saying "Amazon delivery".

How would the keeper go about appealing this or should he just ignore?

Appeal, this PCN is actually beatable at appeal, it genuinely isn't POFA compliant for once having been issued too late. Appeal along the lines of you are appealing as the keeper. You have no intention of naming the driver as there is no legal requirement to do so. As they do not know who the driver is and they issued the PCN outside of the 14 day period they cannot hold the keeper liable for the PCN under the protections of freedoms act 2012. As such they can not pursue you the keeper, and you expect them to cancel it. They might reject the appeal, as might IAS but you actually have strong defence grounds as long as you give them no indication who the driver was.

Thank for this. Should I still mention that the unnamed driver was on a delivery or should I not mention that at all and just appeal on basis of POFA
