PCN Capability Green Luton

Hi
I have received a PCN from euro parking services.
The car was stopped at the roadside for 2mins 28seconds. This was at capability green Luton which is a private business park. There was signage at the side of the road. Once this was read the car was immediately moved.
Letter says "Parked on: Double yellow lines/Crosshatched bay/Restricted area of the car park".
It was neither double yellow nor Crosshatched. It was not obvious that it was private land until signs were read.
I have not contacted them yet or identified the driver.
Please can you advise best way to appeal.

Thank you, and you did originally say this anyway, but that time is less than the minimum “consideration period” in which you’ve chosen not to accept the offered contract.

Others may have additional advice for your appeal.

It's a private business park very close to Luton Airport just off junction 10/10a and attracts those wanting to park awaiting a flight arrival. Other roads closer to the airport are now double red lined and ceo'd at night.

Edit:  There is a Greggs on site open 0600-1800 with five 30 minute spaces.

Notice is not PoFA compliant so no keeper liability on this one.

For those of us still learning how to deal with these invoices, can you elaborate which bit of the notice isn't compliant?

Most of the ones I look at on here don't invite the RK to cough up but this one does and it also specifies the period of parking together with the location......so what have they missed?

Thanks all. I've checked the letter and there is no mention of POFA so it is non compliant.
I'll respond stating this and that I am not obliged to name the driver. Also that they have not acted in accordance with the minimum consideration period. Let me know if there is anything else.

There is no requirement to explicitly state the Protections of Freedom Act 2012, and if the notice complies with its requirements then that’s enough. That said, many notices which do not explicitly state PoFA 2012 don’t comply.

Also got one of these slightly longer stay, I had just stopped to figure out where I was, and actually didn't park here to get out, there's no double lines either, they also left it quite late in sending this, as i'd now have 2 days to pay the lower amount. It's similar to the other person it has the NO PARKING warning sign, facing the driver and then the other sign facing the road had I seen this I would have moved on.

I appealed to Euro car parking with the justification that the consideration period was not observed, thus no contract was established. Appeal was instantly rejected (maybe an automated rejection). I cannot appeal again but must go to IAS who I have little faith in. Is there any point, or is there another course of action you'd recommend?

I did not reveal who was driving.
