PCN APCOA Parking

As the registered keeper I received the below PCN today, the location is Broad Street Plaza, Halifax HX1 1YA visiting Pure Gym.

I was not the driver and I've asked them to advise how/where they parked (still awaiting their response as they are away from home). I’d like to understand if I have to comply with providing the drivers details, I don’t think this notice is compliant? I would be grateful if you could please share the best boiler plate template to use to refuse this.

APCOA never comply with Schedule 4 of the Protection of Freedoms Act to recover the charges from the keeper.

You could therefore appeal as the keeper with the below

Dear Sirs,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, be careful there are no drop down/tick boxes that cause you to identify who was driving, and keep a close eye on your spam folder for their response. If they do not respond within 28 days, chase them.

I've not had a response from APCOA, no autoreply, nothing. Should I chase them or leave until it's been 28 days?

It's only been 7 days. If you've had nothing after 14 days then no harm in chasing.

What is your rush? The operator has to follow the BPA/IPC Private Parking Single Code of Practice (PPSCoP) which states in section 8.4.1(b) as follows:

8.4. Process for appealing a parking charge
8.4.1. Parking operators must provide a process for motorists to appeal against a Parking Charge (including unpaid parking tariff) in accordance with Annex C, which:

a) allows that the parking charge may be appealed within 28 days;
b) requires the parking operator to respond to appeals within 28 days or, where a decision on the appeal is not concluded within 28 days, requires the parking operator to acknowledge the appeal and confirm the timeframe for concluding it, including the supply of additional information;

There is no point "chasing" APCOA until after day 28 if you've not heard anything by then. Unless you know what you are doing, you risk screwing up the easiest of all PCNs to get cancelled by blabbing something that does not need to be said or mentioned.

Calm down. APCOA are benign and do not litigate.

Thanks for that, I'll sit still then, 28 days will be 18th Feb.
