X2 Parking Tickets for Parking in Own Space

Hello all

I have received x2 parking tickets for parking in my own space. I rent an apartment which comes with an allocated bay from my building. UK CPM control the car park and have issued two tickets to my lease company. Both have already made its way back to me. I do have a permit but it simply fell off the windscreen.

I wrote an appeal identifying myself as the registered keeper for 1 ticket to test the waters and they wrote back demanded I name the driver or they will neither accept or reject my appeal?! Can anyone shed any light on what to do next? There will be no POPLA code as they are with the IAS now. I've seen a lot about POFA 2012 is there a loop hole here? Does anyone know what I should do next? I assume because they want the name of the driver they will reject the appeal but it seems crazy to get a ticket for my own space! The space comes with the apartment so the permit has no details of the car etc on it. Seems silly to pay and I don't really have the money. Also not sure what to do in regard to the other ticket.

Is your car leased?

If not, who are the 'lease company'?

Are the PCNs addressed to you at your address?

I wrote an appeal identifying myself as the registered keeper

How can you be the 'registered keeper' if the creditor wrote to the 'lease company' in the first instance?

Let's just clear the decks on these matters before launching into defences, of which there appear to be many.

Agreed. Let's establish your relationship to the vehicle, and exactly what has been sent to whom by whom, etc.

PoFA could be one element of any potential appeals/defences, but it would also be worth getting to the bottom of the underlying issue around your rights in regards to the parking space in question.

The car is leased long term but the lease company provided them with my details. So the attached images are of tickets addressed to me.

I am the registered keeper but not the registered owner I think?

CPM wrote to the lease company, who provided them with my details and they then reissued the fines to me

You're neither, you are the 'hirer'.

So, we may assume based upon your account that the Parking Charge Notices have been issued to you as hirer. In which case IF the creditor wants to be able to enforce against you as 'hirer' then the law, paragraphs 13 and 14 of Schedule 4 to the Protection of Freedoms Act applies:

So, were you supplied with the following in respect of each PCN?

a)a statement signed by or on behalf of the vehicle-hire firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement;

(b)a copy of the hire agreement; and

(c)a copy of a statement of liability signed by the hirer under that hire agreement.


and a copy of 'the notice to keeper;' initially issued to the lease company.

Yes, it's enough to make your eyes roll, but pl don't be tempted to ignore and want to get to grips with signs, lines, permits, tenancy agreements etc. All in good time.

For now, this is procedural.

Forgot to update on this but worth noting I was able to get these cancelled and happy to help anyone in a similar position
