McDonald's Cranford Bath Road - PCN - Overstay

Received PCN yesterday for overstaying in McDonald's Cranford. The limit of stay is 60 minutes but the total stay recorded was 73 minutes. I've attached the PCN for reference. On 4th April, I went to McDonald's with family, the kids took their time to eat but we were about to leave the premises before the stipulated 1 hour. However, my car did not start. I had to press remote lock 5 times to unlock the doors. My home car parking is approximately 2.5 miles away and the car was noisy during the onward travel. I waited for some time and manage to start the car and when I was about to reach the house, power steering stopped working. Eventually the car broke down and I had to involve Road side assistance. Is there any way that I can appeal for this PCN? Kindly suggest.

Believe it or not, this is the short answer...

Any appeal is going to be unsuccessful, even POPLA. Eventually, after safely ignoring all debt recovery letters, you will receive a claim, which, if defended with our advice, will either be struck out or discontinued.

Unless I’m mistaken the PCN makes no mention of POFA so no disclosure of who the driver is/was.

There is no legal requirement to mention PoFA. The only requirement is that all the requirements as laid out in PoFA are fully complied with.

I've evidence of Road-side assistance on the same day in the next 2 hours but not inside McDonald's premises. Shall I explain my situation and make an appeal.

Have you spoken to the manager of the McDonald's? That would be a sensible first step.

Many thanks everyone. I spoke to the manager of McDonalds on 18th April and explained the situation with the car. Showed evidence of breakdown and roadside rescue on the same day. The manager kindly noted down my PCN and Vehicle registration number and informed me that he will notify the parking authority to cancel my parking ticket. I checked the status on 23rd April and the parking ticket was cancelled. Sincere thanks to everyone who responded to my query.
