Hounslow/PCN Received from Euro car parks

This happened in 2022 where I paid and displayed parking tickets but still got a PCN. I disputed this with copy of the ticket and bank statement but my details were passed onto DCB who have now issue claim form for me through CCJ. I have the ticket as proof of payment and bank statement but Euro car park is saying because I didn’t enter my registration number the ticket is invalid. What should I do? Please advise. I have moved since then and no longer own the car but have not received this CCJ Claim form.

You could start by showing us the original Notice to Keeper (NtK) you received making sure you leave all dates and times showing and also show us the N1SDT Claim Form, only redacting your personal details, the claim number and MCOL password.

You really must get a grip on how you expose your personal information. Here is a redacted copy of your claim form and I suggest you delete the other copies which expose your claim number and your MCOL password:

Sorry about that, I’m really still trying to get to work on communication here.
So I nether received the original notice to keeper as I just moved when this happened. Even though I had a redirection in place with the post office the only redirected letter was the final reminder.
After that I wrote to euro car park to explained how I never received their notice to keeper and also told them that I had a ticket with proof of purchase and also advised them of my new address.
How can I delete the previous attachment? Can’t see it anymore. Can you please delete it? Thanks

With an issue date of 6th February, you have until 25th February to submit an Acknowledgement of Service (AoS). By submitting an AoS, you would then have until 4pm on Tuesday 11th March to submit your defence. If you do not submit an AoS, then you have until 4pm on Tuesday 25th March to submit the defence.

Otherwise, here is the defence and link to the draft order that goes with it. You only need to edit your name and the claim number. You sign the defence by typing your full name for the signature and date it. There is nothing to edit in the draft order.

When you're ready you send both documents as PDF attachments in an email to claimresponses.cnbc@justice.gov.uk and CC in yourself. The claim number must be in the email subject field and in the body of the email just put: "Please find attached the defence and draft order in the matter of [claimant] v [your full name] Claim no.: [claim number]."

DEFENCE

1. The Defendant denies the claim in its entirety. The Defendant asserts that there is no liability to the Claimant and that no debt is owed. The claim is without merit and does not adequately disclose any comprehensible cause of action.

2. There is a lack of precise detail in the Particulars of Claim (PoC) in respect of the factual and legal allegations made against the Defendant such that the PoC do not comply with CPR 16.4.

3. The Defendant is unable to plead properly to the PoC because:

(a) The contract referred to is not detailed or attached to the PoC in accordance with CPR PD 16(7.5);

(b) The PoC do not state the exact wording of the clause (or clauses) of the terms and conditions of the contract (or contracts) which is/are relied on;

(c) The PoC do not adequately set out the reason (or reasons) why the claimant asserts the defendant has breached the contract (or contracts)

(d) The PoC do not state with sufficient particularity exactly where the breach occurred, the exact time when the breach occurred and how long it is alleged that the vehicle was parked before the parking charge was allegedly incurred;

(e) The PoC do not state precisely how the sum claimed is calculated, including the basis for any statutory interest, damages, or other charges;

(f) The PoC do not state what proportion of the claim is the parking charge and what proportion is damages;

(g) The PoC do not provide clarity on whether the Defendant is sued as the driver or the keeper of the vehicle, as the claimant cannot plead alternative causes of action without specificity.

4. The Defendant attaches to this defence a copy of a draft order approved by a district judge at another court. The court struck out the claim of its own initiative after determining that the Particulars of Claim failed to comply with CPR 16.4. The judge noted that the claimant had failed to:

(i) Set out the exact wording of the clause (or clauses) of the terms and conditions relied upon;

(ii) Adequately explain the reasons why the defendant was allegedly in breach of contract;

(iii) Provide separate, detailed Particulars of Claim as permitted under CPR PD 7C.5.2(2).

(iv) The court further observed that, given the modest sum claimed, requiring further case management steps would be disproportionate and contrary to the overriding objective. Accordingly, the judge struck out the claim outright rather
than permitting an amendment.

5. The Defendant submits that the same reasoning applies in this case and invites the court to adopt a similar approach by striking out the claim for the Claimant’s failure to comply with CPR 16.4.

Thank you, I tried to enter my claim number but git an error message saying that the number is invalid many times. Not sure what to do

Where are you "trying to enter your claim number"????? You have been told that you only submit the defence by email.

Please confirm that you are NOT trying to use MCOL to submit your defence? DO NOT try to use MCOL to submit your defence. ONLY send it by email as instructed above!!!!!!!

Got you, I was trying to in the MCOL but couldn’t get in anyway. Do do I just copy and paste this letter on an email then?
I’m sorry to ask some stupid questions but this is all new to me and I’m really scared.

I realise these things are daunting the first time round, but your situation will not be helped by rushing or panicking. Take a breath, and read the thread carefully.

Copy and paste the suggested defence into a Word document (or similar), then save it as a PDF file. Download a copy of the draft order. Attach them to an email addressed to the email address provided above, and CC in your own email. Include the subject and text suggested by b789:

I have now sent the email with both defence and draft order in one file to the email with myself in copy.
Just wait and see what happen next.

I received an acknowledgment of my defence from the Tribunal and a copy is being served to the claimant.

So in regards to this issue I now received 2 separate documents in the post this morning and I’m in panic mode. First document is from DCB LEGAL advising that their client intends to proceed with the claim.
The second document is a Notice of proposed allocation to small claims track. I don’t know what to do and where to start at this point.
Any advice is appreciated.

Both completely normal and expected.

I think the notice of allocation gives actions and dates, so please note them and post the notice so we can see it also.
