PCN at Eaton Road, nr Coventry Railway Station

Hi,


I received a PCN from UPKS for parking on Private Land for no more than 15 minutes on Nov 10th 2023 on a dark evening around 5pm.  I sent through the appeal online as follows:


Dear Sirs/Madam, 

I appeal and dispute your 'parking charge', as the keeper of the vehicle. I deny any liability. 

There will be no admissions as to who was driving and no assumptions can be drawn, nor was there an agreed contract. Your signage terms fail the test of 'large lettering' and prominence of the parking charge, as established in ParkingEye Ltd v Beavis, which is fully distinguished. 

Should you fail to cancel this PCN, I require with your rejection letter, all images taken of this vehicle & the signs at the location that day. Do not withhold any images or data later relied on for POPLA/court. 

Firms of your ilk were unanimously condemned in 2018 as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised too; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and say on camera 'we make it up sometimes' (BBC Watchdog).   

I will be making a formal complaint about your predatory conduct to your client landowner, as well as complaining in writing to my MP and ensuring that they are appraised of the debate where Parliament agreed unanimously: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''.   

Formal note: 

Service of any rejection letter/POPLA code and/or legal documents by email is expressly disallowed. All responses to me from this point on, must be made by post. Regardless of any MCOL online/email system, service of any court claim must only be made by first class post to the latest address provided by me.

I’ll have to go and confirm what the signage looks like now but here’s a pic from Google Maps (Aug 2023):

Yup, their typical non reply.

That was a poor appeal, if you read it again there isn't actually an appeal point in there at all, you made some points that could be the start of an actual appeal but never followed them to a conclusion as to why nothing was actually owed. Also making pointless threats is, well, pointless.
There are motorists who have been scammed and those who are yet to be scammed!

It would be wise to acquire photos of the current signage at the site, showing the layout, contents, and visibility (and ideally in similar lighting conditions to at the time of the parking event). If the only signs are the ones seen on Google Maps, then the signage doesn't seem to be the best - particularly if there are cars parked in front of it.

It would also be useful to show us a copy of the original notice you received.

Yep, the signage is as per my original post, so very small boards and no signage upon the entrance and nothing where I turned round my car and parked (I was however facing towards the wall with the signage, albeit across the other side from it).
I've now received a Debt Recovery Plus letter to be paid by 2nd Feb - amount has increased to £160.  One part of me is now thinking just pay the damn thing, but on the other hand I feel I should be making a stand.

Any advice please?

Ignore the debt collection letter. The debt collector is a third party to the contract you allegedly broke with the UKPS. They have no power to do anything, no matter how they threaten you in their correspondence.

You should understand that the debt collectors offer their services Ona no-win, no-fee basis, in the hope that you are low hanging fruit on the gullible tree and will, as you have already intimated, capitulate and pay into their scam.

They’ve already added on a fake debt recovery fee which should never be allowed if this were to get to a small claim hearing. Use all debt collector letters as emergency toilet paper. What you must never ignore is a County Court claim form.

If you move house in the next 6 years be sure to email the UKPS data protection officer notifying your new address and requiring them to "erase" (use that word) your old address.  Best to attach non photo proof of the new address such as a utility bill or updated vehicle registration form (it's important to update the vehicle registration at DVLA as well as your driving licence each time you move).

The easiest way to get a CCJ without knowing about it is to let them sue you at an old address. Royal Mail post forwarding is not 100% reliable and who buys that service for 6 years?
