Help with Simple Procedure

Hello All hoping for some advice here

Car registered to a old address apparently has 19 tickets for a park in scotland ( Multiple users)

I dont live at the address the PCNs had been sent to and didnt collect or forwward mail

Last week i got a call to say i had a sherrif court letter which is a Simple procedure claim from PFS for euro car parks.

I then got a Demand for payment before court action from pollock fairbridge schiavone when i collected
saying i must pay within 7 days or face court procedings

Please help me with what to do!

As a forum, we are not familiar with Scottish law, primarily because - unlike in England and Wales - the liability for private parking invoices can not be transferred from the (usually unknown) driver to the registered keeper, because

does not apply in Scotland.

For single instances the advice is usually to ignore debt collectors and let them do their worst.

Your problem may be that they’re tempted to try something for 19 tickets.

There are a few examples if you search the forum, but not very much. Note that this one particular case eventually led to the claimant backing down, but not immediately.

Has the driver been identified to anyone during the process? Can you post at least one of the PCNs?

I dont have any of the PCN to hand or available.

Should i be asking for copys?

ive never communitcated with anyone so theres no way they have the driver details

Subject Access Request can be used to obtain all personal information held on you, including PCNs, and this legislation is applicable in Scotland. From Euro Car Parks. Asking as the registered keeper, ensuring not to identify the driver.

You need to know on what basis you’re being asked for money.

Update your car’s V5C if it’s wrong and you haven’t done so already.
