Green Parking - simply forgot

Hi everyone,

Hopefully someone here can help me.  I am a regular user of a particular station car park managed by Green Parking - 23 times this year so far.  Unfortunately one day last week I simply forgot to pay via RingGo and, of course, received a Parking Charge Notice To Keeper requesting payment of a Parking Charge Notice of £85 (reduced to £40 if paid within 14 days).

Is it worth following the appeals procedure or is there a better course of action?

Any initial appeal is going to be rejected, no matter what is appealed. However, as this is a BPA member, you will be able to appeal to POPLA. Follow this advice for now:

Easy one to deal with… as long as the unknown drivers identity is not revealed. There is no legal obligation on the known keeper (the recipient of the Notice to Keeper (NtK)) to reveal the identity of the unknown driver and no inference or assumptions can be made.

The NtK is not compliant with all the requirements of PoFA which means that if the unknown driver is not identified, they cannot transfer liability for the charge from the unknown driver to the known keeper.

Use the following as your appeal. No need to embellish or remove anything from it:

I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. Green Parking has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. Green Parking have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

Besides the PoFA failure to be able to hold the Keeper liable, the sign does not conform to the requirements to be able to form a contract by conduct. Without a company number, registered address, or even an explicit statement clarifying Green Parking's legal status (e.g. “Green Parking Ltd, company number 12345678”), you can argue that there’s no clear identification of the contracting party.

Also with it being station parking it's likely to be covered under byelaws, not POFA. Don't tell them who was driving and they have no one to claim against.

Hi everyone,

Thankyou for your help so far - it is very much appreciated.

Green Parking did respond rejecting the appeal but did so in a pdf attachment to an email that was flagged as spam so I have only just seen it.

I presume next steps is to raise to POPLA but I would love to hear if there is anything in particular that needs to be said in order to fight this.

Thank you for your appeal received on 26/06/2025 regarding the above detailed Parking Charge Notice.

We have carefully considered your appeal, however on this occasion the appeal has been rejected for the
following reason (s) :

Not displaying valid ticket/permit, and no valid parking session is on any electronic payment system.

Therefore the Parking Charge Notice has been issued correctly.

We have now extended the discounted payment period by 7 days to allow you time to pay the discounted
settlement amount. Please now make payment of £40.00 to reach us by 17/07/2025 or £85.00 to reach us by
31/07/2025.

We must advise you that once the discounted settlement rate passes it will not be offered again.and therefore you
now have two options:-

You can appeal to an Independent Appeals Service, POPLA (Parking on Private Land Appeals) using the POPLA
Reference code provided above. Please note, should you decide to appeal to POPLA and your appeal is
subsequently rejected, the option to pay a discounted amount will no longer be available and the full amount of
the PCN will become due.

If you decide to appeal to POPLA, you will need to visit their website,www.popla.co.uk , where further details of
how to appeal (either online or by downloading the relevant forms) can be found. If you are unable to access their
website, please call us for further information on how to obtain the forms. Please ensure that your POPLA
Reference Number as noted above is quoted on all correspondence to POPLA.

You have 28 days from the date of this letter to submit an appeal to POPLA. If you appeal to POPLA we will
suspend recovery activity on the PCN and the charge will not increase until the appeal has been determined.

By law we are also required to you that Ombudsman Service (www.ombudsman-services.org/ ) provides an
alternative dispute resolution service that would be competent to deal with your appeal. However, we have not
chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you
must do so to POPLA, as explained above.

If you do not make payment or submit an appeal to POPLA within the relevant timeframe, the outstanding PCN
may be passed to our appointed debt collection agency for further action. All costs associated with this process
will be added to the amount outstanding.

I only put the **** in the above message but do have a valid code - it seems to work ok on the POPLA site.

You said “Issue date: 05/06/2025” but if you meant something like 05/07/2025 then the POPLA code may still be valid, yes.
It should be valid for 33 days from the actual issue date.

I think it may be just in date?

The opening date of 05/06 was the issue date of the PCN.  In the rejection it talks about paying within 7 days to reach them by 17/07 which implies an issue date of the rejection / POPLA code of 10/07.  Usually the validity is 33 days I think?  So it should be good through to 19th August - if the OP can confirm the issue date of the rejection?
