Given their lack of PoFA compliance as jfollows has noted, here's a suitable appeal...

Dear Sirs,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled.

If appealing online, be careful there are no drop down/tick boxes that cause you to identify who was driving, and keep a close eye on your spam folder for their response. If they do not respond within 28 days, chase them.

Is it worth me dropping in any comment on the date period to add a “cherry on top”, and encourage them to let it go?

I don't think there's any need - they'll be well aware of when they issued the notice and the relevant period for PoFA, hence why if you read the notice carefully you'll notice they don't actually claim the ability to hold you liable as the keeper.

They look like photos on foot to me, and the 33 seconds is the time it took to walk from front to back. Were you in Toolstation? What do the signs say about parking? Are you supposed to park on the other side next to the road?

Bingo. It's not the time spent in the car park, just the time the photos were taken. If this were ever to get as far as court etc. that'd be another point to raise, as the times of the photos do not span a long enough period to specify a period of parking - 33 seconds is clearly less than any reasonable consideration period, and without any additional photos, they have provided no evidence that the driver stayed longer than any such period.

For now, I suggest sending the appeal drafted.
