Fined for being in a completely empty car park at night.

Hi

I live in Edinburgh and parked my car at Hermiston Gait Retail Park there between 2342 and 0026 on the night of the 26th of June. I am a recreational drone pilot and have a Youtube Channel. I wanted to film something near that location and figured the empty car park would be the perfect location. I'll be honest and say i didn't look for or see any signs saying the car park was a no go in the very late evening/early morning. I have parked there loads of times and although i know they have signs about the max stay being 4 hours i can't remember even seeing cars cannot park outwith certain times although i am not saying they don't.

So it is a car park with no barrier or gates and i literally entered it and parked 50ft from my entry point. I am going to check, but i think there may be signs about max stay time, but none about out of hours times. I am the only car in a car park with several hundred spaces.

Anyway i get or rather my wife gets a letter today from UKPC as she is the registered keeper saying the car was parked there during a restricted period. It has a discounted fine of £60 within 14 days or £100 after that.If no payment made within 28 days it will go to debt recovery agency. As the car is my wife's name that is the last thing i want and i know it is down to me. I have added a picture. It is taken by my drone and the red circle is my car and the red line shows my route in and out of the car park. That's a very short distance and i don't think a sign about times is displayed on that route.

So

1) If there are no signs about restricted times in the entrance and area of the car park i was in and i can prove it then could i appeal.
2) Or if i am in Scotland can i ignore it anyway as they really cannot do what they say they will and this is all bluff on their part hoping i will pay?

Get your wife to appeal as follows:

"I appeal as registered keeper.

Liability for the parking charge rests with the driver of the vehicle. I have no requirement to name the driver, and I will not be doing so. For the avoidance of doubt, I was not the driver.

You will be aware that under Scots law there is no mechanism via which liability for the charge can be transferred from the driver to the keeper.

I look forward to your confirmation that this charge has been cancelled"
