Euro car parks - Staying longer than maximum period.

Hello Guys,

I received this ticket for parking longer than allowed at a Morrison carpark.

It was parked after closing time so didn't even realise there was a maximum limit.

Do I have any grounds to appeal?

Are you able to show us some photos of the signs? We need to see the terms and conditions.

The standard advice with supermarket charges is to go and speak to the manager ideally with a copy of the receipt from the driver's shopping, but given the driver parked there when the store was closed this is less likely to be successful - Euro Car Parks might have been hired to prevent exactly this sort of parking. But if you are a regular customer there's little to be lost by trying.

80 minutes' overstay (10.34pm to 11.54pm) when the sign (see GSV) restricted to 10 minutes 'outside of store hours'. 'Store hours' as such aren't stated, but the clear implication is that these are the hours in brackets on the sign i.e. in this case 10pm to 6pm.

OP, as a thought, is the car electric or plug-in hybrid?

H C Anderson, are you thinking along the lines of if someone was paying to charge their car, then they're not parked in the car park?

Also, 10 minutes max outside of store hours, is this a common thing? A "get around" clause of the forbidding language usually used (i.e. no parking outside of store hours)?

Hi, Car is not electric.

I'll pop into the store today and see if the Manager can cancel it.

My thought re electric is what else would cause a driver to park their car for such an extendedperiod when the store itself was closed (GSV shows charging points) and whether this could be developed onto a defence.

I've not seen it before but is perhaps a sensible way for them to avoid issues with people asking 'how would I know it's closed', 10 minutes (effectively 20 with grace period) is long enough to know you can't park with the store closed and have time to find out it's closed.

That said, if the store is closed we should be back to GPEOL as there can be no commercial justification as detailed in Beavis.

A short period when store closed is fairly common, on both individual stores and retail parks. It seems more common in more residential areas.

They are generally trying to prevent nuisance. A common issue being youth congregation.
