Euro car parks PCN - parking without authorisation

Hello.
This is my first post so apologies if any details are missing.


On 18/11/23 I parked in the Miller & Carter car park in Swindon for a birthday dinner. However, once we arrived, we waited for around 5-10 minutes and then the receptionist said that there was no space for dinner at that time for at least another hour. Therefore, we decided to eat at another restaurant.
I asked the receptionist if we needed to fill out our reg number anyways, and she advised that it was not needed. We went back into the car and proceeded to call other restaurants to get a booking for dinner. This all took a total of 27 minutes.
 
I have received this PCN and I appealed it stating the information above. Apologies, I do not have a copy of the appeal. They then rejected my appeal. I understand I should have asked for advice before sending an appeal letter and apologies for this.

Please find the attached PCN and rejected appeal letter. I tried to find a picture of the sign on google maps but was not able to. I have also uploaded a picture of the car park, with a red dot showing a part that you further drive down. (note google maps picture is from 2016 so it shows a different named restaurant).

I would greatly appreciate any advise and direction you can provide. Thank you :)

A good first step would be to speak to the restaurant manager, to see if they will intervene and get ECP to cancel the charge. Explain the situation to them, and make clear that you specifically asked about the parking situation, and the only reason you did not register the vehicle was because you were specifically told you did not need to by a staff member.

Make sure it disappears in some way from ECPs system, just in case something goes wrong.
