PCN Appeal declined. Missed response now fine has doubled.

Hi there, so we got a PCN through in mid Oct for parking at a local woodland with a blue badge.

I submitted an appeal based on the fact we had a blue badge. I stupidly didn't realise that the woodland still required pay for parking despite the blue badge.

I also completely missed Nexus email that went into my junk last month.

They've now written to say the fine must be paid at the full fee, not the initial reduction.

I've written back to ask if there's any way that it could be reduced back to the initial fee. How likely is it that they'll take pity and give me the original costing?

There seems to be no way to speak to an actual person, everything is automated.

Is there any more room for appeal?

Incredibly unlikely. Pity doesn't make money.

When they rejected your appeal they will have probably provided a POPLA code, but that only lasts a certain time (from memory, 28 days, but it should say in the email). If so, you could appeal there, but nothing you've said so far indicates a strong avenue of appeal.

Can you show us what you said in your appeal?

Even if you missed the POPLA appeal deadline you could still be able to beat this ticket. It’s not a fine, it’s a demand for an alleged contractual payment that the parking company can only enforce by suing in the county court and winning the case. Can we please see both pages of the PCN (redact any name, address, vehicle number and reference number but leave all dates showing) and also, as requested by DWMB, tell us what you wrote in your appeal.

Presumably the PCN was postal and a Notice to Keeper?

If the operator is a BPA member then in addition to any applicable terms set out in signage at the site and in the PCN the operator must comply with paras. 23.1 to 23.13 of the Code of Practice which refers to 'Appeal Rejection Letters'.

IMO, an email is not a letter.

OP, was a letter attached to the email?

In any event, unless stated clearly to the contrary and agreed to by you by positive action then the operator was obliged to write to you in the same manner as they issued their written NTK.

I mean I was looking out for a letter, not an email. The appeal I submitted was online though, could they just argue that they were responding to the appeal with the same method of communication.

We need to see the PCN, what you wrote in your appeal and a screenshot of their online 'appeal' page(s) so we can see what they and you have put in writing. Only delete personal data from anything you post but keep in all other info and as regards the PCN post both sides pl.
