Author Topic: Greater Anglia PCN from NCP 'partial payment' - refered to POPLA - help please  (Read 129 times)

Firstly, I did not know what I was doing to begin with and my appeal - submitted to POPLA shows I was the driver. Summary of the matter which is currently with POPLA who are gathering evidence from NCP is below. I would welcome any help, thank you.

Happened 2x in subsequent weeks, so two PCNs under consideration.
Parked at Greater Anglia station car park at around 845am
Paid using parking app later that morning as website says you can pay online for a day up to 4am the next morning (included screen shot in response)
The app (Pay by phone) gives you the opportunity to pay for minutes/hours/day - it does not ask for arrival time.
I paid and have a receipt (for each occasion) for a day, which confirms parking until 4am. On both occasions I left before 9pm.
PCN due to breach of T&Cs ‘partial payment, and liability for the same having been brought to the attention of the driver by clear signage in and around the site at the time of parking’
I am refuting this charge on the basis that I followed all guidance and entered information within the parameters of the app, paying the full amount as requested within the time limits prescribed.
Peculiarly, the two appeals I have put in in respect of my PCNs have had two different responses - NCP reduced the first to £20 if I paid quickly and did not bring the case to arbitration - otherwise I would be charged £100.
The second PCN was upheld by NCP and required me to pay £60... unless I brought the matter to POPLA - otherwise it would be £100.

I am the registered keeper of the 2 vehicles - PCN 1 11/12/25 and PCN 2 19/12/25

PCN 1-

I live a bit of a distance from the station car park, but will return there to obtain photos of the ts and cs displayed on signage

I responded to NCP re PCN 1 enclosing the receipt confirming payment was made on the Pay by phone app - copy in album 1

I responded to NCP re PCN 2 enclosing the receipt and copies of PayByPhone screenshots showing there is no option to select anything other than whole minutes/hours/day.

Sadly I have not seen this site until yesterday.
I hope that I have followed the necessary guidelines and really appreciate any help, thank you.

Station car parks were not ‘relevant land’ for the purposes of PoFA 2012 on the dates these PCNs were issued. The law has now changed, but the change is not retrospective. As long as the driver has not been identified, then NCP can not transfer liability from the driver to the registered keeper.

However, the driver has been identified.

Dammit!!
Is there any scope to explore the lack of clarity on the app - it gives you the option to pay for a day and does not ask for arrival time or indicate there are differing rates?
Or the lack of consistency in the NCP responses?
In addition, the NCP response says that any shortfall can be paid at machines at the station - but if you are not aware of a shortfall, how would this be done?

£200 when I have followed the indicated process seems.... harsh.... not a legal standpoint I see, but perhaps there is something around reasonableness?
