Writing as the registered keeper. The driver must of overstayed there by 20-30 minutes. I didn't know the driver had been accused of a parking contravention until I received a letter from the courts closely followed by a letter from BWlegal with a balance due of £255.

I assume Britannia sent notices previously but they did not reach my address, possibly due to having issues with receiving any post at all around the time.

I have emailed BWlegal for evidence of parking contravention but was replied to with a generic 'sign in to portal' which I don't feel I should have to do.

I have also filed the AOS.

What next? Thanks kindly in advance

I now have the original PCN and follow up as below. Thank you

Those img2url links in one of your previous posts don't work for me - apologies if it's an issue at my end, but could you re-upload them using Imgbb?

The NtK is definitely not PoFA compliant so only the driver can be held liable and they have no idea who the driver is.

We should also examine whether Saundersfoot Harbour is land subject to statutory control.

Wow that's incredible thank you.

So Land controlled by statutory byelaws is usually NOT relevant land.

See https://www.ftla.uk/private-parking-tickets/groupnexus-pcn-claim-form-received-dcblegal-forestry-england-land/msg112334/#msg112334 for the full words from the legislation.

@InterCity125 any land on which the parking of a vehicle is subject to statutory control. The mere existence of byelaws is not a silver bullet - those byelaws have to cover the parking of a vehicle. They usually do, but should always be checked.

In this case #31 and #32 of this order would seem to cover parking: https://www.legislation.gov.uk/wsi/2011/1565/contents/made

Providing the vehicle was parked within the area outlined on this rather antiquated map: https://www.legislation.gov.uk/wsi/2011/1565/schedule/5/made

Good point.

And a good find with that map.

So yes, it looks like the car was parked on the northern area of the sea wall and clearly inside the statutory area.

While I was trying to retrieve the original PCN and evidence from Britannia a couple of weeks ago I also emailed Saunderfoot Harbour directly explaining my situation.

In a very unexpected turn of events, a very nice chap from there called me yesterday explaining that the fine will be cancelled as far as Britannia is concerned but there might be a delay while BW Legal receives that info. I'm not sure if it's coincidence or not that BW Legal also finally sent me the original PCN yesterday too.

But it seems that FTLA will have helped me enormously even if he hadn't so thank you again.
