Private parking tickets / Unfair Parking Charge Issuance Notice

Dear sir/madam
I was recently issued a parking ticket for £90 in a lidl car park which I thought it was shared with Brentford County court car park. I had a brief s8 eviction case to hear on 5.6.26 and therefore I used their car parking in a disabled designated space with valid blue badge displayed clearly in my windscreen in my arrival and departure of this car where everybody is legally allowed to park there for 90 mind subject to do some shopping in their lidl store which I did not know of. After I received my ticket I immediately appeal against the private car management team but they denied my appeal and have suggested to re-appeal with the regulatory body called popla (parking on private land appeals). Do you think I have any chance of winning against their decision if I only have a proof of my blue badge, a parking ticket confirming my 69 mins stay in their 90.min stay allowance but no shopping receipt or proof of registration in their vrm or scanning machine input of my first hand registration number plate. I said to them that I did not see any particular signage about inputting these details on my arrival or exist.what is your true predication of my further appeal process through this popla with limited evidence of fence of my blue badge, original parking ticket of my check in and check out times and invitation or appointment letter of the court for my hearing case by on 5.6.26. Has anybody ever experienced a parking charge fine for staying in a shared car park of lidl and Brentford County Court for 69 mins when it is clearly signed that everybody is allowed to park free there for up to 90 mins. I am a blue badge disabled person who cleared displayed my badge on arrival and exist parked in a designated disabled bay for 69 mins but still I got a ticket for £90 fine. I challenged my ticket on following grounds but they still rejected it. This appeal is based on the fact that no breach of the Terms & Conditions occurred and
the operator has not provided evidence that any enforceable contractual term was communicated to me as a disabled motorist.
1. I am a Blue Badge holder and parked in a designated disabled bay. My valid Blue Badge was correctly displayed throughout the entire period of parking.
2. The operator’s own ANPR timestamps confirm:
• Arrival: 10:22:12
• Departure: 11:31:31
• Total stay: 69 minutes
The disabled bay allowance at this site is 90 minutes. I did not exceed the permitted free period.
3. There was no signage at the disabled bays, at the entrance, or elsewhere in the car park stating that:
• The car park was exclusively for Lidl customers,
• Blue Badge holders were prohibited from using the disabled bays when visiting the adjacent Brentford County Court, or
• Blue Badge holders were required to enter their VRM inside the store.
4. The operator has not provided:
• A site map showing the number and location of signs,
• Photographs of the signage,
• The wording of the terms relied upon,
• Evidence that any relevant term was visible from the disabled bays,
• Evidence that Blue Badge users were required to register their VRM.
Without this, the operator has not discharged the burden of proof required under the BPA Code of Practice.
5. As a disabled motorist, I am entitled to reasonable adjustments under the Equality Act 2010. If the operator wishes to impose additional requirements on Blue Badge users (such as VRM entry), these must be clearly and prominently displayed. No such signage was visible.
6. I complied fully with all visible information available at the time of parking. I parked in a disabled bay, displayed my Blue Badge, and remained within the permitted time limit. The operator has not identified any specific sign or term that I allegedly breached.
7. My evidence consists of:
• My valid Blue Badge (front and back),
• The operator’s PCN confirming the 69‑minute stay,
• Court attendance documentation confirming the purpose of my visit.
I cannot provide photographs of signage that was not present or not displayed in a clear and accessible manner.
In summary, I complied with all visible terms, no breach occurred, and the operator has failed to provide evidence that any contractual term was clearly displayed, prominently positioned, or applicable to disabled bay users. For these reasons, I respectfully request that POPLA allow this appeal and cancel the Parking Charge Notice.
Is there anybody who knows of these private car park operator who falsely issues these types of PCN? What are the fundamental rules of parking for disabled people in a private car park for this particular operator known as parking eye and has anybody got their reviews in the social media or trust pilot and who is in charge of regulating their code of practice.
I will be most grateful for anybody's feedback in this particular incident.
