Just bumping this to see if anyone has any suggestions!

Feel like this one might be a clear no chance case but thought I’d check anyway.

My wife was headed south on Tottenham Court Road and was caught in a bus/bike only stretch of the road just past the junction at Chenies Street (exact pin here: https://maps.app.goo.gl/4ASEMzDNrDABU4WU8?g_st=ic)

In her defence, she claims she saw no warning of the upcoming restriction until after passing through the lights. Hard to tell from GSV but the description of the signage seems fairly similar to this successful appeal on the Howland Street junction: https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/help-with-camden-pcns-two-received-one-minute-apart-on-tottenham-court-road/

Hi all.

Thanks as always for your help.

I’ve just received a PCN from a code 46 contravention on 11/02 on 95 London Road, Brighton, BN1 4JF (outside the British Heart Foundation). The location was a loading bay located on a red route.

Timeline:

16.25ish - My wife unloaded a number of items to take into the store to donate.

16.33ish - One item, a suitcase, wasn’t accepted, and so she tried to donate it at the next door Scope charity shop (also unsuccessfully).

16.37 - The recording starts. (The car is parked and she is not visible)

16.40 - She returns to the car, loading the suitcase into the boot.

16.41 - The car leaves the bay.

Annoyingly the council’s evidence only begins at a point where she hasn’t been captured on video unloading charity items for donation.

We do however have an email confirmation of donation from the British Heart Foundation which I hoped could be used as evidence.

Any advice, as always appreciated.

@cp8759 @Incandescent Just to close this off, sharing the response from Enfield Council. They rejected our representations but as a gesture of goodwill cancelled one of the PCNs which is what we hoped for really. Thanks again for your help with this.

I flew - have a pdf of the tickets and can take photos of the passport stamps too which I’ll include with my submission.

I am contesting PCN BH82728030 issued for a code 21 suspended bay violation on Melville Road BN3 1TH on 09/10/23. The offence did not occur.

I was on holiday from 28/09/23, returning 16/10/23 (flight tickets and photos of passport stamps attached as evidence). When I left my vehicle there were no warning signs about the upcoming suspension.

When I returned, my vehicle had been moved to the opposite side of the street. No PCN was attached to the windscreen, only a small white piece of paper detailing the authorised move of my vehicle. Proof of this can be seen in your evidence photos.

As no PCN was served, the Notice to Owner is therefore a nullity.

Hi,

I've received a Notice to Owner for a 21 contravention on 09/10/23 for parking in a suspended bay on Melville Road, BN3 1TH. It says that due to non-payment within 14 days I now owe the full £70.

I was on holiday from 28/09 to 16/10. Before I left there were no suspended bay signs.

When I returned, my car had been moved to the opposite side of the street. On the windscreen was one single piece of white paper which confirmed the date and time the car had been moved. It didn't refer to a fine or a PCN and there was no yellow ticket. I discarded it because I presumed it was just for my information. In their evidence photos you can see just this on my windscreen.

All but one of their photos show the car after it has been moved. The one photo from before only has the suspended bay sign so faintly in the distance it can't be read.

I understand that I could rightfully be fined for being in a suspended bay while I was away from home - but with no way to know I'd been given a fine, how could I pay it? They seem to lack the proof to prove that I was given a ticket - but maybe I'm wrong.

Any advice on how to appeal appreciated!

Thanks so much for your help. It was my fault for missing the signage - like the other poster, I haven’t encountered many bus gates and I think I had other things on my mind that morning. No excuse!

Anyway, I’ve drafted a response and will try and return to collect some photos of the approach to the bus gate. In the meantime, any suggestions on improving this greatly appreciated.

I am contesting PCNs EF96635685 & EF96640652 issued for a bus gate violation on Bull Lane N18 at 09:45 and 12:16 respectively.

The journey was for an essential appointment for the treatment of my father’s cancer at North Middlesex University Hospital, which borders the bus lane. I have supplied proof of this appointment.

Having taken this journey many times previously, I wasn’t aware of the new bus gate. The lack of advance warning signs (supplied photos) meant I was caught unaware as I passed through.

Furthermore, I didn’t have the opportunity to learn from my mistake, receiving a second PCN for our return journey just 2.5 hours later.

I kindly request a review of both PCNs, with a request that at the least you would consider cancelling PCN EF96640652 for our return journey. Receiving these both came as a considerable shock and at a very difficult time for the family.

I’ve received 2x PCNs for a bus gate violation on the morning of 24/10.

From reading other posts it appears it’s a new bus gate and a bit of a deliberate trap as I can see a number of other drivers who’ve been caught out.

Aware other posts have claimed the signage is accurate and appropriate.

Our only mitigating factors are as follows:

1. That we’ve driven that route many times before and weren’t aware of the change.
2. We would have avoided it if we’d have received the first PCN (the two contraventions were just 2.5h apart so received them both just this week)
3. I was dropping off my father for an appointment at the hospital that borders the bus gate.

Would appreciate any advice/if it’s worth appealing!
