Free Traffic Legal Advice

To update anyone who may be interested, I lodged an appeal with Napier Parking who rejected it. I then compiled an appeal to the IAS focusing on Napier's failure to comply with the Private Parking Sector Single Code of Practice (February 2025). Today I am pleased to report that I received this notification:

Thank you for your appeal. Due to further information Napier Parking Ltd has confirmed they will no longer be pursuing the matter and the parking charge has been cancelled.

I would be grateful for any advice in respect of a PCN issued by Napier Parking for which they have rejected my appeal. It can now go to IAS but I have read that appeals are usually not successful (PoPLA has greater success rates, according to my research).

Circumstances: Arrived at car park on Saturday 28 February 2026 at 09.23. The fee of £2.80 applicable for the entire day, or part thereof (the weekend tariff), was paid at 14.43 after a problem with my phone. I left the car park at 20.08 on 28 February. I have the RingGo receipt for the payment of £2.80 (plus RingGo Convenience Fee of £0.20) and supplied that in my appeal demonstrating that no loss had been incurred on their side.

The landowner and/or parking company have suffered no loss as the fee would have been the same whether paid at 0923 or 1443. There has been no offer by Napier Parking to refund the fee paid, and so I have fulfilled my side of any contract for parking.

The Private Parking Sector Single Code of Practice, February 2025 edition, Annex F, states:
F.1 Exempt Circumstances
...
Parking Charges must not be pursued in relation to vehicles where evidence is provided that they are identified as...
...
j) a vehicle parked in a car park managed by fixed camera technology (ANPR and/or CCTV) for which payment has been made for the full period of parking prior to leaving the car park.
NOTE: This exempt circumstance only relates to the timing of making payment. It does not exempt a motorist from parking charges which have been issued for other contraventions such as;
Partial or under payment for the time parked;

It seems to me that I have met the circumstances shown in j) of the Annex. Napier Parking is a member of IPC which is a co-signatory to the Code.
