Hi Incandescent (and all)

Thought I'd post an update on this one, as I today received 'Charge Certificates' (with a 50% increase on the charge) for the four PCNs I have appealed.

On 18 February, I submitted the appeal for the four PCNs from January 2026. The confirmation email said they'd confirm whether it was accepted within 7 days, but I didn't get confirmation until early this morning (3 March) that the appeal has been listed for hearing on 25 August 2026.

Then I today received the four 'Charge Certificates' (dated 2 March), which noted they've been sent because they haven't been informed that an appeal has been made. While it sounds like there has been a delay by the Tribunal, am I right in finding it hard to believe the first the council would have heard about the appeal is the confirmation of the listing date?

I have also sent an email to our three councillors on 19 February, with one responding to say that they will lodge a Councillor enquiry into this matter.

Given I'm unfamiliar with this process here in the UK, do you have any thoughts / guidance on how to approach these 'Charge Certificates' to make sure the PCNs are actually "paused" pending the appeal hearing. I have already drafted a follow-up email to the Councillor.

Do you think it would add weight to our position to pay the first PCN (before the Council's incorrect advice)? I assume we have limited (to no) ability to challenge that one?

Given the 14 day "discount" period is nearly up, would you recommend appealing to the Tribunal as well as contacting the councillors?

Also, do you think there is any 'goodwill" argument to paying the first PCN given we don't appear to have strong arguments to challenge this one (unless you can see any)?

Did you have any further guidance / thoughts on their responses to the other four PCNs after taking a look at the documents I uploaded, or is what you have shared to date our best bet?

Indeed!  I'd imagine it is a case of all or nothing for PCNs 2-5 as well, as the arguments for those 4 PCNs are all the same.

Apologies - I've been meaning to post up the full PCNs and responses since your first response.  I've uploaded all pages of the 5 PCNs and the 4 responses I received (apologies, they came all together in one envelope, and I forgot to mention we've only received responses to the first 4 PCNs - but I suspect the response to the 5th one will be the same).

Re the representations, I can't work out how to find a record of the submission - but I emailed the text for the representations to myself when uploading them (for fear the form would lose what I typed). There are two screenshots of this text in the GDrive folder - we made the same representation for PCNs 2-5.

Appreciate that (and, more broadly, your time and responses), Incandescent - we agree they're disproportionate! Hopefully the Council and/or the LT would agree. We never intended to do the wrong thing - in fact we tried to do the right thing - and have ended up with a number of penalties.  Having perused some of the other posts, I can see we are just one case of many!

With respect to contacting our local councillor, do you have any guidance on how to go about that (given, I assume, PCN complaints aren't the top of their agendas)? Just thought I'd ask given we're new to the city/country, otherwise I'll jump on Google.

Thanks Incandescent.  Given my formal representations (text linked in the GDrive folder) have been rejected, I assume the only way to make those representations is by going to the tribunal - or is there another way?

Do you have any guidance on our prospects at the tribunal?  We appreciate that this route presents 'double or nothing' stakes, but hope that the Council provided incorrect guidance would be sufficient for the Tribunal member to recommend the Council waive the PCNs.

With respect to the first PCN, are we better to pay this now and challenge the other four at the tribunal on that basis? Or would you suggest we challenge all 5 (i.e., are there arguments we can make to have the first one waived too)?

That's right, all the same contravention - entering/exiting Ham Park Road (two relate to passing the signs at Margery Road, and the other three relates to passing the signs at Devenay Road).

The main issue, I believe, is that the information the Council provided us over the phone was incorrect and we relied on this to continue passing the signs on Ham Park Road.

We purchased what we were told by the Council representative was the correct permit (an Access Permit, alongside the Resident Permit we already held). However, given the further PCNs, it appears that the advice from the Council representative was incorrect and we actually needed a third permit (which we're not entitled to given we are not Blue Badge Holders).

It appears this is what the WHP01 relates to - but the signage doesn't make this clear, as we held one permit at the time of the first contravention (but not the right one, as the Council representative informed us) and then two permits at the time of the following four contraventions (neither of which are the right ones, as we now know) .

There is information on the Newham Council website: https://www.newham.gov.uk/parking-permits/apply-access-permit/4, but we weren't aware of this until receiving the rejection letter.  The Access Permit we were told to purchase was the " Healthy School Streets Access permit" (which we do need to access Ham Park Road during certain hours due a primary school on this road). The separate Blue Badge permit (WHP01) was not mentioned during our call with the Council, so just purchased the permit we were told we needed. I don't recall seeing anything during the permit purchase process, and the permit confirmation, doesn't mention anything around the separate permit for the West Ham Park's "People Friendly Streets".

I can confirm we are not still passing the signs. We thought the first PCN was sent it error, but after we received the second and third PCNs (which I assume was on 13 Jan, or later in the day on 12 Jan), we didn't want to risk receiving further PCNs.

Is the first page of the first PCN ok, or do you need all pages?

Re the signage, is there anything in the WHP01 permit requirement not being clear to the driver of a vehicle? Might be a stretch, but when one is driving, they don't have time to research the permit requirements - or would the Council just say the driver would be expected to pull over and safely find out the requirements before passing through?

The list of PCNs with contravention date and PCN date are as follows:
- PCN Date: 7 January 2026, contravention 16 December 2025.
- PCN Date: 9 January 2026, contravention 2 January 2026.
- PCN Date: 9 January 2026, contravention 3 January 2026.
- PCN Date: 12 January 2026, contravention 5 January 2026.
- PCN Date: 20 January 2026, contravention 12 January 2026.
I didn't think to note down the date that I received each PCN in the post, but I would have challenged the subsequent PCNs on the day they were received (due to the surprise / frustration). The confirmation of submission emails I received were dated 10 January, 13 January, 13 January, 16 January and 21 January.

On the call where the Council said we had the right permit (arvo of 16 Dec or morning of 17 Dec), the representative also said that there were no fines showing at that time of the call - but the 16 December contravention was at 8.25am, so should have been picked up by the camera. Is there anything in that, or would the Council just say there is a delay between the camera recording a contravention and it being logged as a contravention in their system?

Any guidance on approach is much appreciated.  One thought I had on 'strategy' is to pay the first one at the discounted amount given (I assume) I'd have low (or lower) prospects of success on challenging that one, but then appeal the subsequent four.

Hi all

Just wanted to check in to see if anyone was able to provide some assistance / guidance on this one.

We wouldn't have used those entrances/exits to Ham Park Road if we had known there was a specific permit (and not one of the two we already had), and certainly wouldn't have kept using them had the Newham Council representative told us we were fine after getting the second permit!

Please let me know if any additional information is required - as noted, I can upload all of pages of each PCN and rejection if required (it will be a fair few pages though, so thought the first page of one would be a starting point for initial guidance around potentially challenging at the tribunal).

Hi all

Kudos to all involved in providing this forum - it looks like a great help to people! I wish we had found it sooner, but hope you might still be able to help us in some way.

We are not from London (or the UK), so didn't do any digging / research before submitting our "formal representations". In considering whether to appeal our formal representations having been rejected, we came across this forum and thought we would reach out. We initially want to know whether we have indeed shot ourselves in the foot by challenging the PCNs we received, or if there is still scope to contest.

We have 5 PCNs for alleged contraventions in entering Ham Park Road via Devenay Road / Margery Road on 16 Dec 2025, 2 Jan 2026, 3 Jan 2026, 5 Jan 2026 and 12 Jan 2026. These total a hefty sum, so naturally wanted to explore our ability to contest them.

The text from our representations provides the context, but the summary of our predicament is:
- immediately after purchasing a car, we purchased a residents permit and thought we were then able to enter both ends of Ham Park Road and park as permit holders.
- after the first time driving through the access point (16 Dec 2025), we had "driver's remorse" so I called Newham Council to confirm. The representative said we needed a second "Access" permit to drive down Ham Park Road, and then we would be ok to enter Ham Park from both ends. So we made the purchase on 17 Dec 2025.
- On 7 Jan 2026, we received our first PCN and challenged it. Once we received the second one, we stopped entering Ham Park Road from either end.

I've only uploaded the correspondence for the first PCN, but can upload the others if there might be scope to contest.

The Google Street View location links for the signage at each end of Ham Park Road are:
- Devenay Road - here - apologies, it is quite hard to see the signage through the zoom. It appears the Google cars don't drive that far down Ham Park Road any longer.
