Hey all,

See the following response from the council https://imgpile.com/p/AnNTmPf . I'll also added my intial appeal I sent below.

"I wish to submit an informal challenge to this PCN and ask the Council to review the circumstances at this location. For over 15 years this section of the street operated with marked pavement parking bays, and parking in this manner has continued openly and without enforcement long after the removal of the markings. As a result, residents have continued to park in the same manner in the reasonable belief that enforcement was not taking place. On this occasion the vehicle was parked in line with other vehicles at the dropped kerb and sufficient clear width remained for pedestrian use, as shown in the photographs. No obstruction was caused. This is the first PCN I have received at this location.I respectfully request confirmation of the Traffic Management Order or other authorisation currently in force for this location. Yours faithfully"

Looks like they've not responded to any of my requests or queries. Their standing on the point of clear violation of Code 62. Thoughts?Time to pay up the discounted 70 quid?

Thanks both, I think I’ll go head with the informal appeal on the website before deciding of a formal one once I get the NCO. I’m leaning to accept the discount if this gets rejected but will get some opinions here once the responds.

Would you be able to help mock up something for the appeal? Including the point mentioned around :

-legitimate expectation
- basis of long standing parking
- traffic order details and map

Thanks

Carriageway has double yellows all the way done the road, can’t be seen in photos as it does stop on the section where I’m parked also a bus lane shortly ahead.

I do remember maybe 10+ years ago these exact spots where I was parked used to have marked white parking bays on the pavement. But never had signage such as permits or time plates.

I guess that weakens my case further if not completely , will await your thoughts.

Hey ,

first timer on ftla so just wanted to get advice with my first PCN. I,ve been parked in front of my drive since 1st December (of course not all day due to work etc.) no issues , just seen today a pcn on windscreen for issues yesterday 13/12 for contravention 62.

Need any advice on in intially the grounds of the pcn and appealing. I totally understand why but I just find it so strange lived here nearly 20 years no one has ever got a ticket there , everyone parks the same way all down the road and I’ve never seen a ticket for. I’ve attached the link to the pcn and the google maps link for clarity.

Appreciate the council do not care about the above just wanted to to get intially advice and what to do to appeal (if valid ). Again love here for years not blocking the pathway you can even see in the photos the parking officer took ,my neighbours park exactly how I am and that’s the same all down the street. No signs on our road either.

https://imgpile.com/p/lcaNsyP#phevkJn Yellow box where I was parked , red boxes myself and my neighbours dropped kerbs. Black dot there is a black and white poll . Neighbours have always said anything past this to the right has always resulted in a pcn
