Hi All, I have some update on this case. 
The Newham council was probably waiting for me to pay the Full GBP240, till the last day.  Today I received the following message to an enquiry I made on the 28th of August (Next day of receiving the Charge Notice) - I could not do it any earlier than that as I thought counsel is taking there own sweet time to respond to my Representation (they say 56 days, but also they say there is no obligation of timeline), the Charge Notice came as a surprise.

Anyways please see this email I received today.  Please let me know in terms of next steps, as they have surely not sent the Notice of Rejection to me via email or Post, and hence why they are offering me 'goodwill discount' - whilst eating up my window to go to the Tribunal (Notice of Rejection back-dated 15th July 2025).  I would have shared the Notice of Rejection here, but I cant seems to be able to attach any doc here.

Good afternoon,

We are writing with regards to your enquiry form,

You have stated that you did not receive a response to your representation.


Please be advised that, following a review of our records, we can confirm that a Notice of Rejection was issued on 15/07/2025 in response to your representation. For your reference, a copy of this Notice has been attached.


Your enquiry has been received outside the time period allowed and it is now too late to make representation, as a Charge Certificate has been issued there is no further right of appeal.


As a gesture of goodwill the discounted payment of £80.00 will be accepted, if paid before 17 September 2025.


Failure to pay the reduced payment will result in the fine being registered as a debt at the County Court. An Order for Recovery notice will be issued and this will incur an additional charge.


PAYMENT CAN BE MADE AS FOLLOWS:
 

Online - Visit www.newham.gov.uk and follow the payment links to pay by credit/debit card.

Thanks for the responses.  I have downloaded the form PE-3 and the guide to fill.  I note that some of the parts can only be filled once I know who would be witnessing it.  I also note that it needs to be sworn in front of a Solicitor.  Since going to County Court during working days of the week is not possible for me, I would need to get an appointment with a Solicitor near me(South East London).  It looks like the council has made the damage by giving me the PCN, and time + costs, it will end up costing atleast the same amount as the original penalty charge - such is life.

As Solicitor contacts in the Lewisham/Greenwich Area of South East London would be much appreciated for the Statutory Dec,ration witnessing process please.

Thanks for your reply and suggestion, as honestly I was feeling a bit under pressure to pay the Charge Notice as time is ticking and I didnt want a debt through enforcement to blemish my credit rating or anything.  I tried calling the Newham Council as well to find more information, but it was just an automated line which kept going in loops.

Is there a portal for TEC on which we could check the status of registration of the PCN? - or is it something that needs to be done over email/phone?

Hi All

I got a PCN for driving through a restricted road, i.e. Royal Albert Way / Gallions Roundabout E16, which is within the Newham Council. Contravention date 30 May 2025.  i received the PCN on 11th June-25.


I made a representation/Appeal through the council's website, for which I got the confirmation reference number and ackowledgement of Representation submission(auto reply email).  I made the representation in mid-June'25, and today to my surprise I received a Charge Notice, saying that the penalty amount has now increased by 50% to GBP240, since I did not pay the original within the stipulated time.

I am a bit surprised, shocked and angry all at the same time as I was expecting a response to appeal first of all.  The Charge Notice does not have any contact details of the council or anything and I can't go through the council's website to appeal against the Charge Notice or anything.  It may well be an administrative error on the council's part but only they know, we are simply victims of their 'innocence'.  Also the Charge Notice is demanding the payment of the penalty within 14 days of the Notice Date (i.e. 21st August 2025), where as I only received it through post today 27th August.

Since I never received the Notice of Rejection letter, I am not sure how I can take this to the Tribunal.  This looks to be by design and the Council is trying to extract maximum value out of me.  There is a page of the council website 'Not received a response to a PCN challenge or representation', which has a deadlink if you click to submit a PCN Enquiry.  Is there no accountability on the council on there procedures and preying on people.

Any advice on what I should do would be much appreciated.
