I contacted the CEO’s office and one of his staff emailed back this morning to confirm it had been cancelled.

Actually, thinking about it, it can’t be a maximum stay of 20 minutes as the ANPR also covers the main supermarket and there is no way they’d only allow 20 mins max in the car park?

But we’ll sit tight as suggested and I’ll update as and when

Thanks for the swift reply! I was hoping that was the case but thought it prudent to start a thread now for when things happen further down the line.

My father is fine with me acting in his name and, believe me, Sainsbury’s have lost at least 4 regular customers out of principle!

Afternoon. Was hoping I wouldn’t be back so soon, but here we are….

My father has received the attached NtK for overstaying the maximum time period in a Sainsbury’s fuel station.

The driver was on their way to work in an unfamiliar area and needed to fill up. On getting to Sainsbury’s the driver saw that they didn’t open until 6am but as staff had arrived and were opening up, pulled into the forecourt to wait.

The driver then filled up, paid and left by 6.13am. Receipt also attached.

My father then received the PCN today. We now believe there is a 20 minute maximum waiting period.

Looking at other threads I decided to approach Sainsbury’s first in the hope they’d cancel the PCN. Unfortunately the store in question is over a hundred mile round trip, so going in person isn’t an option so I telephoned (twice) instead asking to speak to the manager. On both occasions, despite giving different reasons for my call (to get past switchboard), they refused to put me through and said the matter had to be dealt with via Euro Car Parks.

I then sent a DM via Twitter in the hope that would yield a better result, but was once again told the only option was to engage with Euro Car Parks.

Is the notice PoFA compliant / is there other methods to get it cancelled?

My father is elderly (and disabled) so I am assisting him with this - and having tried to get the matter resolved with Sainsbury’s, to no avail, hope someone here can help

If the notice is watertight then I guess I will have to make the round trip to the store in person to speak to the manager

Afternoon. Just to let you know I received an email today from APCOA informing me they had “carefully considered” my appeal and have cancelled the notice.

Morning, gang. Today I have received this from APCOA. Should I just ignore it or reply along the lines with “I do not have to and will not supply this information”?

We have carefully reviewed your appeal and understand that you were not the driver at the time the
alleged contravention took place.

To allow us to fully investigate your case, we kindly request that you
provide the following details of the driver:

• Name and Surname
• Complete address including postcode

Please provide your information within 14 days of the date of this letter of request.

We have placed your case on hold for 14 days to allow you to comply with this request.

I have every faith in your confidence! The irony is, if they had have answered my call / web chat and allowed me to pay (albeit late) then they would have had their £7. Do you think they will cancel it at this stage or will I need to go through the motions of POPLA and the worthless stream of debt collecting letters?

Thanks for the swift reply. This is what I used & made no mention of who was the driver.

I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Stansted Airport is not 'relevant land'.

If Stansted Airport wanted to hold owners or keepers liable under Airport Bylaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a bylaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

Hi all. I stumbled across this site after trying (& failing) to visit Pepipoo, of which I was a lurker & received help with previous issues.

I’ve received the attached PN from APCOA for not paying the set down fee at Stansted Airport. I knew it was in the pipeline as I had attempted to pay (from abroad) but was unable to. I tried calling them & using their online chat but after over an hour each time, I gave up & decided to wait for the dreaded PN - which I was prepared to pay until I came across this wonderful “new” site.

I received it on 28th July and after searching for similar cases here,  appealed the same day using the template given re PoFA and airport land etc.

I have only, so far, received the acknowledgment email but knowing it will progress, thought I’d start a thread now for when that time comes.

I am the RK, although it is a motability vehicle (hence the PN, I presume, stating Company Secretary) & so don’t physically hold the V5C

To confirm, I wasn’t the driver & was being dropped off to catch a flight (that I can prove).

If there’s anything else I should do in the meantime, please let me know & many, many thanks in advance.
