Another update to the saga. DCB have emailed today requesting I call them about an offer to settle. As you will no doubt recommend, I have not called them, nor have I replied to their email.

What happens now? Is it again waiting to see whether Smart Parking are prepared to pay the court fees in order to gain back the claim value of roughly the same amount?

Further update. Just recieved a Notice of Transfer as per the following scan:

Assume we are still at the "hurry up & wait" stage for DCB to do the right things & cancel their spurious claim? If I understand the letter correctly, this is just a notice & further details will follow.

Just checked MCOL & the status now says "transferred to Northampton on 17/04/2026". What does that mean? Is that the court?

I also have had a missed call or two from what I suspect was DCB, assume trying to settle ahead of any court thing?

Now in uncharted water, any guidance on what typically happens next very much appreciated.

Hi all,

Update following my mediation call this morning. I followed the suggested script outlined above with the following outcomes:

-Claimant could not/woould not confirm authrotity to negotiate/settle.
-Role/title was legal litigation assistant (or something like that)
-they had shared a settlment offfer of £200 (downn fro mthe claim of £350ish) which I rejected
-the mediator said that then means this is likely to go to court unless the clainment/I settle seperately, or they discontinue

That was about the extent of the call.

Any suggestions on next course of action are most welcome

I have finally recieved an invite to attend/recieve a mediation call. Just to sense check this, is the guidance still inline with the advice outlined in the last post in this thread:

For the mediation call, the only requirement is for you "attend" the call. It is not part of the judicial process and no judge is involved.

This is what I advise you to say when you receive the call from the mediator:

“Before I set out my position, please confirm from the claimant’s side:

• the full name of the person attending for them;
• their role/position at their legal representative’s firm; and
• whether they hold written authority to negotiate and settle today.

Please relay that back to me before we continue.”

After the mediator calls back...

If identified and authority confirmed:

“Thank you. I’m content to proceed on that basis. My settlement offer is £0, or I invite the claimant to discontinue with no order as to costs.”

If no/unclear authority:

“Please record that the claimant’s attendee has not confirmed settlement authority. My position remains that liability is denied and my offer is £0, subject to prompt approval by an authorised solicitor if they choose to discontinue.”

If the mediator probes your defence:

”In what capacity are you asking that question? Are you legally trained?  If not, please refrain from offering opinions. I will be reporting any attempt to do so as inappropriate.”

All you need to know is the name and the position of the person acting for the claimant and report that back to us. It will be over within minutes. Complete waste of time otherwise.

What does this mean? Have not recieved anything further in the post or email that I've seen.Is there something more I need to fill out/return? Or is it still just a case of hurry up & wait?

Hi all, just checking in. Have not received any further notice yet since the receipt/acknowledgement of my defense on MCOL e.g. no N180 either in the post or otherwise. Question, is there a time limit by which this needs to occur as its been over a month now since my defense was recorded.

Thanks for the super quick note, genuinely appreciated. I have checked MCOL & there is no notification or update as yet beyond confirm of my original defense submission, so will hold fire until such times as that updates per your guidance.

The only thing I am not clear on however is how long I have to respond. I recieved DCB's questionnaire on 5th Jan. I've downloaded & completed the N180 form as suggested in the above post, but just want to confirm what sort of timeframe I have to email this in as per the explanation on the above thread?

Yes, you will receive a letter saying that they have reviewed your defence and their client intends to proceed and a copy of their N180 DQ.

Quick update just for info & benefit of others like me who do not know this process at all - recieved acknowlegdement/recipet of defence submission, so now assume we wait for DCBL to reply, if at all.

Many thanks for this - I would not have known to do any of this without your help & probably would have fubar'd it as yuou noted. I've pasted the text into the appropriate field on the MCOL website & have submitted. I assume its now a case of hurry up & wait for their reply/assessment?
