bump - any advice helpful how to structure challenge to the photo evidence provided

and video evidence does not show me passing the sign (have won appeal with tfl bus lane in same manner)

as you can see in response, LA state in other words they believe I did not need loading bay

I reached out to Big K transport manager, he explained to me all their appeals relating to parking charges when loading are dealt with by attaching the invoice / loading sheet hence they shared the invoice with me to send to the LA

I pick up jobs, ad-hoc basos, self-employed via different apps to deliver/pick up goods, courier in my own vehicle

I refer to the company invoice confirming the delivery of charcoal / coal bags which need to be unloaded, and delivered then returned.

Newham Council tried to argue that I had ample time and it was not a necessity.

pushing this up. for some thoughts

i wanted to check if my appeal for taking the left turn is valid on the basis:

1. cctv does not display sign (worked with tfl appeal on a bus lane cctv charge)

2. sign was obscured with black paint, local authority has tried to mitigate this appeal point I made, with photos of the sign, taken on the same day I made the left turn. I want to challenge this and ask for time stamp and digital copy to verify the metadata that it was truly taken at that time

@Hippocrates given the CCTV does not display the signage (no left turn) (which was also obscured)

similar to the bus lane appeal with TFL can I prompt them to prove the sign was there and clean and not obscured with paint or graffiti spray

@stamfordman yes, if you click the google drive link, in the NoR letter the LA have supposedly gone out on the same day and taken photos of the sign.

You can see from the images the black residue is visible which obscured the sign

I was working in the area and recognised the multiple pedestrian prohibited turns all around the area. This specific sign when approaching was obscured with black graffiti or paint. Hence why i made the specific left turn, I was unable to confirm the signs, not clear adequate signage.

 I made this clear during the appeal process, which the LA haven’t called out explicitly but provided photos and surprisingly photos taken of the sign and date stamped it as the same day the alleged contravention occurred!

By the time I received the PCN (cctv) by post and returned the sign still had some paint on it but looked like the weather rain or a scrub had reduced the obscurity.

I want to take this forward as the evidence provided by the local authority, I want to challenge it given the time stamp isn’t on the photo provided so it could have been cleaned by staff and photo taken on the same day later on the day. Or more seriously, it isn’t authentic, I’d like the digital copy to check the metadata location and time of the photo was taken?

Hi checking if anyone can provide guidance as the council (local authority) has referred to previous tribunal cases:

2250374502 - however the appellant did not make a case of the signage

2250472997 ( FR65871744) - however appellant does not make a case of any issues

Both adjudicators state the signage is clear however as seen on GSW, there are no advance signs on the main road before turning, as a driver you should make the turn while clear, I would have only seen the sign during half turn, again there were pedestrians which I was watching and watching oncoming road potential traffic. If I compare to other adequate signage I would refer to authorities who put up signage on the main road and on the side road turning point itself. is this enough?

@tincombe yes, they only observed for such a limited time. Unloading a few bags, trolly to building and up and back. Takes more than 5-7 minutes

Do I just say it as it is or is there any structure recommended to present my case to tribunal
