Background
I was issued a PCN 46 for parking in a white marked bay. This a Red route. The signage is confusing and led to the offence. I have atttached the following documents for reference:

My arguement
The sign next to the bay states "No Stopping Mon-Sat 7AM to 7PM". To enforce this, TFL should have marked the bay in RED. Instead, TFL marked the bay in WHITE. As a working parent with young children rushing between appointments, I seek signage from TFL in accordance with Highway Code. In this particular case, the signage was misleading for the following reasons:
  • for No Stopping , the box markings should have been RED and not WHITE
  • The adjacent bay is also marked in white (but with correct signage)


How can you help?
Could you please check if the above arguement would work? Anything I can add to strengthen the case?

Got some good news today! The council has cancelled my PCN and apologised, which I didn't expect at all. See attached letter

I have been driving along this road for 5 years now and was on autopilot mode!


Other aspect is that there may be a technical appeal argument based on Merton mismanagement of the enforcement process, so wait a bit but don't miss the deadline for submitting reps or paying which is 28 days from the date of the PCN. You are still within the 14 day discount period.
Do you think they might contact me and inform of an error?

Merton Council implemented Experimental Road Closures in the Pincott Road area from 14th March 2025. The closures are non-physical but enforced using ANPR cameras. I was issued a PCN for an alleged contravention on 29th March 2025.

I am not local to the area but visit the area around once a week. As the road rule changes were introduced only recently, I was unaware of them and this resulted in a penalty.

Questions
  • For enforcement of moving traffic contraventions, shouldn't the council offer warning notices for the first six months or at least the first time?
  • Do I have any chance of fighting this?
