Lidl have agreed to cancel the PCN after I contacted both customer support and CEO 🎉. Contacted them on 17th June and they agreed to cancel by 19th June. So only took about 48 hours for them to agree to it which in my experience is fast.

One reminder letter from Parkingeye a few days ago but assume that's just a delay in processing/postage.

Thank you everyone for your help. Hopefully that marks the end of the matter.

You say in the thread title that the car park is not owned by Lidl. Is the car park shared with other stores, like a retail park? The fact that Lidl may not own the car park, is not the issue. It is who contracted ParkingEye to operate the parking there.

It is not a retail park. It is just one Lidl store and the manager I spoke to on the day about the parking said that they rent the land from another company. He said there was nothing he could do about a potential fine but he's likely to say that whether true or not.

Do you have a receipt or evidence of any Lidl purchases on the day? Plan A is to always try and get Lidl to get the PCN cancelled. If you tried and were robed off by some lowly customer service bod, then aim as high up the management food chain as you can go, starting with the CEO, Ryan McDonnell.

I have digital receipts yes, on the Lidl app.

Don't appeal to ParkingEye until you've heard back from your complaint to Ryan McDonnell. If you've not heard anything back by Tuesday 8th July, then just follow this advice to send an appeal to ParkingEye:

Isn't it safer to appeal before the end of the 14 day window so as to still have the option of paying the discounted charge?
Is the date of issue really 10/06/2025 when I only received the letter today?

I will otherwise, do as you say and email Ryan McDonnell now.

Thank you both for your advice so far.

Additionally, my son suffers from a medical condition that means he needs to breastfeed more often and longer than other babies. In case that's useful.

Hi All,

My partner, 4-week-old baby son and I went to Lidl to do our weekly shop. Baby needed feeding which delayed shop. There was also a significant queue (probably around 4 min long but that's not so unusual).

- Arrived and spent maybe around 45 mins feeding and changing baby.
- Started doing shopping.
- Finished shop but was 16 mins over the 90 minute max time.

Is the breastfeeding a mitigating circumstance here? Is it not discriminatory to allow a shorter period of time for breastfeeding mothers? Or does it become irrelevant if the breastfeeding and first and the shopping is done second?

Should I simply try to appeal this using the above reasoning and hope for the best? Is there a chance with POPLA?

Any thoughts and advice greatly appreciated. Thank you.

Photos of PCN below. I do not have a photo of the signage but from memory nothing was obscuring it and it stated clearly the 90 minute maximum parking time. You can see a blurry version on google maps.

I think without a clear basis to appeal I will pay the discounted fine.

The arguments above might work but, as far as I understand, it would likely go to the formal appeal stage and then I would lose my discount?

Therefore, unless there is some new information I will pay the discounted fine tomorrow.

Thank you both for your advice.

Thank you all for the information provided so far.

So, it looks like the order stands up? As a newbie, I'm guessing that the parking order is for the purposes of giving them authority to issue PCNs in that location?

In any event, there are no warnings at the site that a penalty charge of £50 might be payable for a breach of the location's terms and conditions and simply stating that a 'penalty charge may be issued' is insufficient.

Is this really an argument that might be successful on its own? Playing devils advocate, why would they need to give an exact figure to the PCN - I believe in Rotherham PCN's are either £70 or £50, so it's public information. Having said that, in private car parks I've always seen the threat of fines quoted in exact figures.

Is Code 86 the correct code since it says "Parked beyond the bay markings" when there are no bays marked (even in what we assume is the parking area) and this is not what the terms board refers to? If challenged, would the council simply reissue the PCN with the correct wording?

Hi, does anyone have any opinion on this? Don't want to wait until day 13 before someone starting to advise me on this.

Thank you in advance to anybody reading :)

Hi John,

I've added the additional photos and the GSV link as suggested and read the 'read first' post. Let me know if you think I should repost a new topic rather than modify like I have done or anything else you think I should add.

Thanks!

Hi All,

My partner and I thought this access road - see photos - was a public street, therefore wasn't paying attention to any signage and could therefore park.

Got a ticket within 1 hour of parking and since worked out that it looks like it is an access road to a private property presumably owned by Rotherham council. Signage says no parking but the driver didn't see this and the sign is actually angled slightly away when walking up the hill so if you miss it when arriving, you're likely to never see it.

After posting on UK reddit legal advice they suggested a number of arguments might be worth trying but weren't totally sure:

- Signage isn't as obvious as it might be and there's no sign saying you are entering or on private land.
- Can the council actually issue PCNs on their own private land where there are no road markings?

The ticket itself (see images) says "location: Liberty House Car Park" which is incorrect since it is an access road to the car park.

Any advice and discussion would be greatly appreciated. Particularly interested in whether the council has the authority from TFA 2004 to issue PCNs on its own land.

Thank you
