Yes i told him and he said i should appeal.
I got annoyed and left it on the car whilst finishing up my unloading, a bit silly as it started to rain right after

Thurrock Council PCN issued while I was unloading bulky items (mirrors and business equipment) for a new business opening in the mall right infront of me. Unloading was continuous and required multiple trips. I'm a 5'3 59kg female so takes a bit of time to unload large mirrors into a mall and return

Parking attendant says he observed for approx 9 minutes. I returned to the vehicle before the PCN was actually served. I have a photo showing him standing next to my vehicle with no PCN on the windscreen. The PCN was printed and then placed on there while I was present.

The PCN was left on the vehicle during heavy rain and is now largely illegible, including the PCN date and full contravention details.

At this stage I am asking:
• does returning before service strengthen the loading defence?
• is a 9 minute observation sufficient to rebut loading?
• how best to deploy the illegible PCN point?

I will upload redacted photos and the PCN once advised.

What happened
I parked on Cart Lane in the afternoon and displayed a valid blue badge with time clock correctly set and clearly visible on the dashboard.
The vehicle was parked on double yellow lines.
The PCN was issued despite the blue badge being displayed.
Photos taken immediately after show the badge and clock visible through the windscreen.
I understand blue badge holders are permitted to park on double yellow lines for up to three hours unless specific loading bans or additional restrictions apply, and I did not see any signage indicating such restrictions at this location.

I am seeking advice on whether the contravention occurred, whether the signage and restrictions are compliant, and the best grounds for an informal challenge.

Why didn't Mum move the car when the traffic warden appeared? Because she thought she was legally parked?

yeah and was taking a call so musn't have noticed the warden till he placed the ticket on the car

My mum received a parking ticket, for parking in a suspended bay and she was unaware of this, She was still in the car and received the ticket, from the photos I cannot see the sign of the suspended bay next to the car or the space so unsure of how clear it was for her, but she also didn't leave the car and drove off shortly after without getting out. How do I appeal this please

I have attached my defence along with their response.

I initially responded on 3/11/24, and the rejection was issued on 5/11/24. However, I did not receive the rejection until 28/11/24 due to it being sent to the wrong address. Upon receiving it, I immediately responded on the same date, stating that I had not received it in time but was willing to pay the discounted rate of £65 instead of £130.

On 9/12/24, I received a response stating that they would not be engaging in any further correspondence. Subsequently, a surcharge of £65 on top of the £130  was applied on 11/12/24. Unfortunately, I was away at the time and did not see both letters until my return 14/01/25.

To be fair, I was willing to pay the discounted rate and was awaiting a response to my message sent on 28/11.

Hi All,

I received a Penalty Charge Notice (PCN) from Barking and Dagenham Council for making a prohibited left turn. I initially contested the fine, as I was following Google Maps, did not notice the restriction, and have no memory of the turn. However, my appeal was declined.

I did not receive the council’s response within 14 days, likely due to delays caused by my change of address and mail forwarding. As a result, I emailed the council requesting that they honor the discounted charge of £65 instead of the increased £130, but I did not receive a response.

Subsequently, I received another letter informing me that the fine had increased to £195. I find this unreasonable, as I had every intention of paying the initial fine but was hindered by circumstances beyond my control. Despite my efforts to communicate with the council, my emails were ignored, and the charge was further increased.

Timeline of Events:
PCN Issued: 02/10/24
Rejection Notice Dated: 05/11/24 (Received on 28/11/24) – Charge increased to £130
My Online Response 28/11/24: I requested updated signage evidence and explained that Google Maps directed me to the turn. I also asked for email correspondence due to postal delays.
Further Charge Increase Letter: Received a few days later, but I cannot locate this letter.
Letter on 03/12/24: Stated that the council would no longer respond to further correspondence.
Final Demand on 01/01/25: Asking for £195.
The payment portal still shows an option to pay, despite the deadline passing. Given that I responded to each letter when I received it, do you recommend escalating this to court, or should I proceed with payment?

the amount had been increased to £130 when I got the rejection dated 5/11/2024.
I responded online with the below -

The evidence provided shows a restriction dated 2022. Could you please provide a current photo of the sign as of 2024? I have also attached a screenshot of my journey on the day, which shows that Google Maps directed me to take the turn to avoid traffic on the A13. No restriction was indicated on the app, nor did I see any signage on the day of the contravention.

I would also appreciate it if you could respond via email, as there seems to be a delay with postal correspondence, which is not ideal given the time restrictions for addressing the PCN.'

and a following letter 01/01/25 attached asking to pay the £195. Its past 7 days but it still shows the option to pay online, is it worth taking to court as I responded to each letter when received.

I believe the £195 charge is disproportionate to the offense, especially given that I made an effort to address the situation in good faith. I am now unsure of how to proceed. Should I ignore the charge and allow it to escalate to court, or is there another course of action you would recommend? Please advise.
