Thank you, Mr Chips, for your quick response.

The original video did show my vehicle entering the hatched space, as well as the vehicle that came out of side road without waiting at the white lines, but now after it was edited, only shows the last bit, which is being used to back the Council's refusal.

This type of action diminishes any faith a motorist could have in such organisations for justice and fairness.

I need assistance from a younger person to correctly post up the paperwork for your perusal - which I will attempt this weekend.

Rejection of Representations dated 26/06/26 was received on 30/06, so I believe deadline for applying to Tribunal is coming up fast (not sure if 28 days from 26/06 is start of clock or date of receipt).

Hi,

I hope someone can clarify what I could do under the following circumstances:

PCN received for alleged moving traffic contravention (yellow box junction), and Representations were made in a timely manner.

After 103 days, Council's rejection received, but they have not responded to an important aspect where the video showed a vehicle from a side road that did not abide by Highway code Rule 172, nor obey the 'right of way' rule, and caused my vehicle to get stuck in the box.

Council has not only ignored that issue, but it has now altered the original video which showed that vehicle's errant action that caused alleged infringement in the first instance, by reducing that which it showed initially.

I'm at stage of applying to London Tribunal, but the main issue that I appealed on has been edited out by the Council, & Adjudicators will not be able to see the original video which told the whole story.

How can I request the original copy, please?

Would much appreciate any advice from you on this very helpful site.

Apologies for the delay as I could not post the images successfully, and had to meet up with my daughter for help in forwarding the relevant photos.

On the day, I proceeded onto Gliddon Rd from Palliser Rd where it met Margravine Gdns,  entering the box slowly when I saw the vehicles ahead moving along.  I don't recall getting trapped within - which is what the LA is alleging.  I certainly was not blocking the path of any vehicles.

Also included is a photo of the junction box that is longer/wider than the road leading to that point - which I hope will help.

Hammersmith appears to have set up many box junctions in multiple spots, resulting in traffic being mostly backed up, at busy times as nobody can move for fear of getting trapped in the hatched area. 

For example, just today mine was the first vehicle in a queue of cars at a crossroad with a box junction, but could not join the traffic until after the lights had changed five times (stationary for over 30 minutes), due to the long tailbacks on the main road preventing cars from proceeding further.

Dear Moderators,

I would like to ask for your help & advice.

Daughter has received PCN for 31J alleged infringement as she is Keeper, but I was driving and she was at work.  Grounds for representations do not include category to state she "was not Driver".  Should we start the process by declaring that fact?

Although the PCN says "stopped on YBJ", the vehicle was still proceeding slowly behind traffic in front.  Shall load up the details tonight.

Also, I notice the PCN does not make reference to any Legislation, and wonder if this is the norm?

Only just caught up with recent post and have only about 7 days to respond, and would appreciate any assistance.

Hello Moderators,

Now back having been away for a few weeks.  In that time I forwarded N180 to CNBC & Claimant.  However, although I indicated dates I would not be available for the Mediation appointment, the allocation has been within that period.  I have checked by phone if a different date could be assigned, and the response was 'No'.  Since it is a date when I would be in a country without the best communication systems, I feel I may be at a disadvantage on the day if Mediator is unable to easily get through to me.

Also, should I have received Claimant's N180 by now?  MCOL site does not include it under the assigned Ref. number, and neither have I received any relevant email from them.

Any clarification based on your past experience would be appreciated.

Hello b789,
This is a quick update to let you know that I have been checking MCOL daily, but it has thus far not updated anything after my submission was recorded.  I am leaving tomorrow morning, and will be away until early December. 

Shall keep on checking MCOL site, and am hoping both parties will email rather  than resort to the post. (CNBC's recent letter dated 10/10 is post-marked 14/10).  Very much aware my N180 is yet to be submitted - especially with information of which dates I will not be available for any mediation that could be proposed. 

In the meantime, thanks for your advice and guidance.

I'm concerned that if the N180 form does not arrive in the post before end of this month, I may not have the means to inform the court system.  (I'm hoping the email address would be used for the purpose).

When I checked via MCOL today there was no response yet from other side.  Not sure if the MCOL system can be used for informing of my non-availability?

Hello Moderators,

Have received acknowledgement from CNBC, of receipt of my defence forwarded via MCOL.

They state
"A copy is being served on the claimant.  The claimant may contact you direct to attempt to resolve any dispute.  If the dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed.  The court will then inform you of what will happen.
Where he wishes to proceed, the claimant must contact the court within 28 days after receiving a  copy of your defence.  After that period has elapsed, the claim will be stayed.  The only action the claimant can then take will be to apply to a judge for an order lifting the stay."

I have a problem in that I will be away from UK for 5 weeks from November, and am not sure what impact that will have on the normal process from this point on. I certainly do not want the Parking firm to win due to my absence!

(Do the documents forwarded to you earlier this month highlight any aspects that could be used in a witness statement?)

Would be grateful for your advice on how I should proceed.
