#2 PCN Code 53J Entering a pedestrian zone - Barnet Council
on 02 Dec, 2024 12:16 in Civil penalty charge notices (Councils, TFL and so on)
Hi allI have received PCN for a traffic contravention: 53J Failing to comply with a restriction on vehicles entering the pedestrian zone (camera enforcement)https://imgur.com/gallery/pcn-T3l1EdZThis occurred at Cricklewood Lane into Dersingham Road NW2. https://maps.app.goo.gl/kpB6YbQmq9LtjnXb9 I am trying to understand if I have any grounds to contest this, and how to go about it. This is a temporary restricted zone for vehicles next to some schools, presumably for safety. Based on the pictures, I have no dispute about this being my car, me being the driver, the actually penalty etc. On the one hand, they have me bang to rights, however there a few points that I would want to try and raise:- My main issue is that I dont feel the signage is very visible from the road, especially when turning from Cricklewood lane as I did. The hours are very small and hard to read in safe manner, before you have already turned onto the road. - In the video clip (will try to upload shortly), there is another car entering this same restricted zone from further up the road. If there are two cars within 10 seconds of each other entering the zone from different ends of the road, surely this suggests the current signage is inadequate at preventing entry to the road? Surely there must be dozens of these contraventions occurring every week?- These are fairly new restriction - google street view from 2022 shows no signs. It seems like it may have begun in late 2023 or in 2024 (https://www.engage.barnet.gov.uk/we-asked-you-said-we-did/news_feed/school-streets-childs-hill-primary-school). I’m a local resident living on an adjoining street, and was entirely unaware that this road had this restriction, until receiving this ticketSome additional context, is that I'm a new driver, and this PCN occured on just the second day of me owning/using my first car. I doubt there is any chance of leniency for this, but it feels very frustrating as I had just been aware of this as a road that cars are regularly driving down, and timing has just caused me to recieve a large fine. I felt I was being extra vigilant and careful, so cant understand how I would have missed the signage if it was actually adequate. Is it worth me asking why is there not more obvious warnings e.g. flashing lights like in temporary 20mph speed zones near schools, or something similar? Referring again to the fact that another car has driven down this road at the same time as me, it doesn't feel like this zone is actually helping create a safe area near the school, instead it is just catching out drivers to pay penalties.Last thing I would also query is the timings involved. It's almost 4 weeks from the alleged contravention occurring until this notice has been sent. And then the date of notice is the 19th Nov, but I only received it on the 22nd. Are these timings normal?I think if I read the dates right, I need to respond by the end of today/tomorrow? (I've been away for the past week, so haven't had a chance to clear this until now)Thanks all!
