Thanks for your reply.

The image link above includes the notice of rejection.

I have since set up an autopay account for the tunnel and I wish i had included that in my Representation.

I had another look at the PCN and weirdly the TFL website has allowed me to make representation again, which I have done and it states the PCN is now on hold again?  Must be an error. I received a conformation email regarding this too?

Hello. 

I used the Blakwell and Silvertown Tunnel on the way back from Folkstone Eurotunnel and didn't pay the charge.  It was a genuine mistake as I haven't used the tunnel for at least 10, if not more, and then is was free.  The charges have only been in place since April this year and I would have paid if I was aware, I missed the signs (not a good excuse I know)

I have already sent a letter based on a thread I saw here, but it has been rejected and the fine is £90, which is very high and something I really cant afford right now so any help would be greatly appreciated.  I'll post all correspondence below.  Thanks in advance.

MY RESPONSE TO PCN: 

Dear Sir/Madam

I recently received a Penalty Charge Notice for using the Blackwall or Silvertown Tunnel YJ8642801. This came as a complete surprise, as I wasn’t aware the tunnels are now subject to a charge. I didn't notice any signs on the day and would have paid the fee had I realised it was required.

From what I’ve read, this is a new scheme and I understand there may have been a period where warnings were issued instead of fines. Unfortunately, I didn’t receive any such warning and this was my first time using the tunnel since the new charge began.  I was returning from holiday and I normally use the Dartford Crossing but on this occasion,  there were traffic issues and I was redirected to the Blackwall or Silvertown Tunnel.

I’m kindly asking if you’d consider cancelling the PCN on this occasion. I am happy to pay the fee for using the tunnel, which I would have done on the day if I had been aware this was required.

I also require a copy of the council decision which made the order.

 
My response is as follows:


The suspensions in Wellfield Avenue were required for gully drain cleaning to help reduce flooding which falls within the maintenance remit of the borough wide temporary order. Site notices were displayed within the designated road on. Attached is a copy of the temporary traffic management order which was produced to cover all maintenance works within the borough and the public notice that was on display at the time of the restrictions. This order came in to force on 19th September 2024 and is enforceable for up to 18 months.

The signs were erected 5th October 2024, to give residents and motorists sufficient warning of the upcoming restrictions ahead. Attached are the images of the signs which include the date, time and location of the signs.

Success! PCN cancelled.

I challenged the PCN as advised by H C Andersen, and received this reply today:

Thank you for writing to us.

Although your PCN was correctly issued, we have cancelled it on this occasion.

You were parked where there are yellow stripes on the kerb and white 'No loading' signs. The kerb
stripes mean you are not allowed to park – even to load or unload – at certain times. A double kerb
stripe means the rule applies 24 hours a day. A single kerb stripe, as in your case, means the rule
applies some of the time (the sign shows the times). If no days are shown on the sign, the rule applies
seven days a week. You were issued a PCN for parking at a time when the rule applies. The purpose
of this rule is to improve traffic flow and safety at busy times.

The 10 minutes statutory observation grace period only applies, when the vehicle was first legally
parked or where permitted parking item expires, which this case, end by 17:00 as shown on the time
clock at the location. The vehicle was parked in a loading restriction and contravening the restriction
in place.

You were parked on a loading restriction. Pay and Display tickets are not valid here at the time; it is
only usable in bays at the times stated on the signs plate.
If you get another PCN in similar circumstances, we may decide not to cancel it.

Hi

I parked my car at 16:46 on Saturday 07/12/24.  The parking sign stated that the restricted time ended at 17:00, so I paid for 15 mins of parking.  On returning to the car I had a parking ticket.  So I took photos of signs and car etc.  I honestly could not understand why I had been given ticket and I thought I had complied completely with the parking restrictions, purchasing the required parking. 

When I got home and studied the images I noticed at the top of the pole was another much smaller sign that is maybe the problem, stating no parking between 5-7.

If this is the case, I feel like I have walked into a trap.  I was following the parking restrictions between 9am-5am, but then at the top of the pole in a much small less visible sign there is a restriction between 5-7.  Surely this is too confusing and should be just as visible, same font and colour as the parking sign with the restrictions I followed.

Any help would be very much appreciated, as I genuinely feel like this is a deliberate attempt to miss lead and confuse anyone trying to park that is unfamiliar with the restrictions.
