The mediator called back shortly after the first phone call to state that DCBL would be happy to settler out of court for £80.00. I stuck by my guns and said I offer £0 zero pounds and have attended the mediation meeting.

Literally as you predicted, they are lowering their offer substantially presumably to remain out of court.
£250 1st offer to £80 second offer is quite a jump down.

Hi
The mediator called this morning and I used your advice.
The mediator tried to take certain sentences I used over to the party after he asked me questions about the case this far.
I instructed that the only thing to take over to them is that "I wish to pay £0.00 and have attended the call as asked".

Hopefully this works. It was all very scary and uncertain. But, I hope this course of action does keep me out of court and sees them run away with their tail between their legs.

UPDATE

Have just received an email from noreply_scms_confirmation@justice.gov.uk
They have scheduled a mediation phone call with me for late February where they call both parties separately.
They have attached a PDF for "Delegation of authority to mediate"
Wharfs the best thing to do going forwards?

Hi, in reply to b789, Yes a letter has indeed came through from the DCB Legal people dated 08/01/2025.
The letter states that yes, their client still wishes to pursue the claim and meet me in court unless settled quickly outside of court etc..
They have also sent with that letter, a "Directions Questionnaire (Small Claims Track)" of 4 pages in length.
So, As instructed above, Disregard that or file it and await the N180 DQ from the CNBC?

Hi again,

Apologies for delay in response.
Currently in a bit of life turmoil with jobs, work etc but hanging in there. Thank you so much for your responses.
I found a letter issued by the UKPC on 09/06/2024.
Some mail including the original parking charge found its way to an old address before I got to change my address on my registration for license so, I missed a few letters including the first notice.

The UKPC states I was on site from 22:31:29pm to 22:41:35pm (10 minutes and 6 seconds).
Luckily I acquired this letter through the post from my old estate agents who forwarded me my mail from my previous address after I emailed them.
Back then I was only being asked for £60.00 but alas, I never knew this letter existed.

So, to be 100% sure, I follow your link in previous message and it takes me to a drop box file that offers me a step by step solution on how to apply to the AoS? Is this correct?

Hi there,

Thanks so much for replying.
I have attached the claim letter whilst covering my personal details, claim number and password.

in answer to your questions;
The McD's was open and the 24-hour open drive through was used.
Food was purchased from the drive through.
I believe that the vehicle was on site for no longer than 10 minutes or so or less.

Sadly, I did not see any apparent signage relating to terms of car park use having used the car park so often over the years, it never happened before. these parking fines must have been introduced in recent times.

After I was issued a private parking notice by DCB Legal back in June 2024 for "using car park out of hours" whilst at a McDonalds drive through, they have now upped their stance to a claim letter from UK Parking Control Limited of Direct House, Runcorn, WA7 1UG.

I must note that during the trip to the drive through, the car head lamps stayed on as did the car engine and no one never left the car. The images on the claim letter I received also clearly show my car with head lamps turned on in the drive through lane.

I did a month or two ago, talk on the phone with DCBL and said that the car wasn't parked, but was only using a drive through. Do they have me by the long, short, and curly's now because of my admittance to driving the car?

My stance is that clearly, I was not parked and did not use the car park for any parking whatsoever during my visit to the drive through.
The claim letter includes court and legal representatives fee's so is it getting serious or still a cheeky ruse to obtain money from me using scare tactics?

Please may you kindly advise the best course of action going forward?
