Speeding and other criminal offences / Court Summons sent to wrong address for speeding fine
« on: October 18, 2024, 04:25:50 pm »
Hi,
Looking for some help:
I originally chose to do a speeding course however, I missed it. I was waiting a renewed notice, or indication of the penalty via email or letter. A letter came but it was sent to my old address.
Is there anyway of contesting this. I've missed the plea deadline by a week. However have been trying to find the right authority all of last week, bounced around different departments & bodies.
Do I have a case? The original penalty notice was sent to my new address but the court summons wasn't.
I've used chat-gpt and come up with this, is this useful at all?
STATUTORY DECLARATION
I, [Your Full Name], of [Your Current Address], do solemnly and sincerely declare that:
On [Date You Learned of Conviction], I first became aware of a conviction and/or fine for a speeding offense dated [Date of Offense].
I did not receive any prior notification, summons, or court documents regarding this matter as they were sent to my previous address at [Old Address], which I vacated on [Date of Move].
I was not living at the old address at the time the documents were sent and, therefore, had no opportunity to make a plea or defend myself in court.
I have since updated my address with the relevant authorities, including the DVLA, and had no knowledge of this court action until [Date].
Therefore, I respectfully request that this court set aside the conviction and rehear the case, allowing me the opportunity to present my defense or plea.
I make this declaration under the Statutory Declarations Act 1835, conscientiously believing the same to be true, and by virtue of the provisions of the Statutory Declarations Act 1835.
