In light of this procedural impropriety please cancel the PCN.

I received a NTO. Do I still stand a decent chance at tribunal with the above argument? I haven't been able to find any precedents yet.
Images of the NTO below (I'm on day 13 from the date of the NTO, was away for work for part of that).
The NTO does state that the penalty charge must be paid no later than the last day of the period of 28 days beginning with the date on which "the NTO is served". How do I know when it was served? It's not necessarily the same date as the posting date.

So to be clear
1) ‘Loading’ markings on the bay itself are optional? This would have hands down been more noticeable and grabbed my attention
2) signs are allowed to be offset, to some extent, to the road? For future reference this is good to know, although I’d say it’s indicative of poor maintenance by a council.
3) it’s acceptable to put a planter next to a sign and have it partially obscured? If I didn’t notice this sign in daylight, I’d hate to know how people could see it at night. To me it’s just common sense not to have a plant right next to a sign, shame there isn’t a regulation about this.

Hello!
I parked in Kingston (London), specifically at The Triangle, to drop off a heavy parcel. It's a small road of around 8 bays. As you enter you see signs mentioning that the parking is free for one hour. As the first 6 bays were taken I parked in one of the last two bays.
I was surprised to see a PCN when I returned (I was gone for only 3 minutes). Apparently these last two bays are mix use parking bays (loading only and 1 hour free) depending on the time of day. The CEO was still there when I returned. The Goods Only vehicle loading is applicable up to 12pm, after which there is free parking. I had parked at 11:40am.

My points of contention are:
1) The sign is not parallel to the road. It is slightly offset, unhelpfully pointing away from the bay, and therefore was not visually impactful or obvious, particularly in light of the earlier signs for the other bays.
2) the top of the sign referring to goods only vehicles was partially obscured by the hanging flower pot right next to it
3) The CEO was still there, I made the above two points to him and also told him that a 'Loading Only' marking on the ground would be more useful and visually impactful. It was he who pointed out to me that the Loading Only markings are there, but virtually wiped out. He even suggested I should take a photo of it and use it in my appeal if I wish.

Do I have any grounds for appeal please, or is this a lost cause? In particular are the Loading Only markings on the road compulsory or not? Hello,
I did park right next to the sign initially, then the car behind me moved away so I reversed a couple of spaces as it was closer to the pharmacy (call me lazy).
I honestly did not chance my arm, I genuinely didn't look up to the very top of the sign column when I parked, I just saw parking starts 10am and thought that was that. Popped in to the pharmacy to browse and pick up my thyroxine prescription as I had run out of supplies.
I am wiser than to risk any chances with London wardens, they're everywhere.

Five different related parking information boards on a single column!
1. Ringo sign with location number
2. A "30 minute free parking sign"
3. The largest one, designed to catch your eye, which is a 10am-4pm parking applies sign
4. A no loading sign, 10am-4pm
5. The no parking sign at the top, which I didn't see when looking through the passenger window from the driver side.

Five. And if information overload like that trips up me, a London resident, I can't imagine how confusing something like this might be to a non-native speaking tourist.

Hello,
I was passing through Wimbledon village around 9am. While sitting in my car I saw the Ringo parking code at eye level, I opened the app but it said no parking was applicable at that time. I looked up and saw parking was applicable from 10am. So I popped out for less than 10 minutes to pick up a prescription, came back and there was the fine. Took a close look at the very top of the sign column and saw reference to no parking. I hadn’t seen this while sitting in my car. With so many boards it does get a bit confusing. Do I have any chance to contest this successfully?

Thanks. The very first question they ask during the appeal online is “are you the driver of the vehicle?”,
I can select yes, no or just proceed by not answering it. Does it matter what option I choose? Same with the next question asking if I’m the registered keeper (yes, no or leave it unanswered).

Private parking tickets / Civil Enforcement PCN - compliant with BPA?

Hello,
The driver visited Sacred Heart Church in Wimbledon on February 12th and parked in their car park. The driver went to enquire about funeral services in the Church lobby. There is a 15 minute grace period before cameras issue a PCN. The driver was there for 18 minutes and hadn’t realised they should have registered their car number plate on one of the tablets in the Presbytery reception.

The PCN is from a company called Civil Enforcement, and  was received yesterday in the post (March 5th), but has an issue Issue Date on it of February 28th. I would like to know if I have grounds to appeal on the following:

- The photos on the PCN do not bear any time stamps and as far as I can tell they look slightly cropped. There seems to be no way to view them online. This isn’t line with requirement of BPA ATA CoP 21.5?
- I can’t tell if this operator relies on POFA 2012, how can I tell? If they do, the notice is dated more than 14 days after the alleged contravention. I only received the notice yesterday, so have already lost 5 of the 14 days to pay the discounted rate.
- I only over-stayed by 3 minutes

Do I, the registered keeper, have any other grounds for appeal please?

I received an NIP for marginal speeding, are police supposed to give you the option of providing your name as the driver online? I am only given the option of responding via post out of pocket

Hello, so I tried to pay this fine today, however I got a message on the Council website that the payment didn't go through. I tried two more times with the same card, same message.
I checked my bank statement, and it shows the charge went through 3 times (can't tell if they are in 'pending' or not). It's a debit card, yes it works fine with other merchants and I have the funds available.

The Council will accept cheques as an alternative but my bank is an online only bank which doesn't issue cheque books. I'd be willing to pay in cash or with my American Express card but the Council doesn't accept either.

So I am at somewhat of a Mexican standoff. What happens if I get an NTO? I've tried in good faith to pay, and no the Council shouldn't expect me to try another debit card from a family member (what if I didn't have any surviving family?).

This case the other day indicates the signs at each end is probably going to satisfy an adjudicator and your bay isn't that long.

Mr Totman has challenged this PCN throughout on the basis that this 60 metre parking bay has a single sign centrally placed and not the required sign at either end of the bay. The Council has not contested this requirement, maintaining instead that the signage was adequate to alert motorists and that the point raised amounts to "a minor defect". I do not regard the omission of a sign at either bay end of a 60 metre parking bay to be a minor defect. In my judgement, such an omission could only be regarded as a substantial defect. I allow the appeal for that reason.

She was not aware of this, and parked on the eastbound side directly opposite a pay & display sign.
The permit holder only signs on her side of the road were spaced 60 metres apart hence she didn't see them as she parked right in the middle of the two very small sign posts


This doesn't tallly with the evidence which shows the car parked opposite 'The King's Club' and the applicable traffic sign on lamppost 005 which was a matter of a few metres to the rear of the car, not in the middle of a 60-metre long parking place implicitly approx. 30m from either sign.

The car was parked nowhere near the sign post 005,
30m is still a heck of a distance to try and spot a small sign side on! I’ve seen other councils minimize the distance between signs to 30m, not 60m
