Hello folks

This contravention happened at night & whilst using iPhone maps satnav. It was the middle of London & I was following the instructions.

I have no access to a laptop at present, but I shall do my best to upload info with my phone, not ideal, but best I can do right now.

The PCN states SOUTHWARK STREET W-BND JW SOUTHWARK BRIDGE ROAD SE1

Back story, my son kindly booked accommodation for me to attend his engagement party in London. As a disabled driver I have to drive to carry belongings etc in the car. It was to be a joyous event after some very traumatic months, bereavements & stress. Traffic was gridlocked, it was very dark. This PCN was my reward!

I will do my best to post the info received, despite being rubbish with technology.

I don’t have all the info only some, the council have said X no of tickets, some with them, some with one bailiff, some with the other. I have just emailed to request all tickets so that I can get advice to evaluate validity. Fingers crossed they do that at least.

She is diagnosed with various issues, Bipolar being the main one, but PTSD, general anxiety, OCD, a type of personality disorder, can’t remember off the top of my head. It’s a long standing thing that fluctuates, but right now she’s on a complete downer triggered by various traumatic/stressful events.

It is very important indeed to find out which PCN's are still with the council and at what stage they are at (Charge Certificate/Order or Recovery etc).

Which local authority have issued PCN's against your daughter?

Given your daughters circumstances, is she in receipt of any benefits?
Does she work?
Is she a single parent?

Bailiff Advice Online

Worthing council, hopefully will get a list shortly, I don't have everything, only what I have been able to find.
She is self employed as a landlord, which helps with flexibility and lack of contact with people, most things can be dealt with at the end of a phone without leaving the house, but her confidence when she is in a manic stage, ie, I dont need benefits, I'm okay now type of attitude saw her refusing benefits going forward. She lost her PIP for lack of reply and I am no longer her appointee, so unable to help on that front. Yes she is a single parent, 3 children, one child on the spectrum, the other two probably ADHD, the youngest only 2.

Consider seeking advice from Bailiff Advice Online. They are specialists at your sort of situation.

Please post up any Bailiff issued Notice of Enforcement that you have. Redact the name and address.

I’ve requested info on all tickets issued from council as I don’t have them all, I will do the same with the bailiffs.

You know we need more info to go on, so some legwork for you I'm afraid.

PCN issue dates and contraventions pl.
Dates of NTOs, if applicable e.g. parking contraventions need NTOs but moving traffic do not etc.
Dates of Orders for Recovery;
Dates of Notices of Enforcement(one for each PCN).

You'll need the above for bailiffadviceonline (BAO).

Has her medical condition been diagnosed BAO would need this as well.

Still I have not received any further correspondence regarding this ticket? After moving I set up a mail redirection to ensure I get my mail. I'm hoping I can forget about it, what are the chances that they don't want to process it?

Hi folks

Thank you in advance for replies.

My daughter is going through a terrible mental health decline and has failed to open her mail etc. I have opened her mail and found several letters from bailiffs and council regarding multiple tickets, sadly I do not have them all. I have contacted the council (with letter of authority) to request that they recall all the tickets so that they can be totalled and dealt with. They have refused. Equally I have written to one of the bailiffs requesting the same, because they told her that they could take her car, which is on finance and sell it, take their monies and give her the balance. That bailiff was very intimidating and I have complained and requested the evidence of the "training" they allege to have to deal with vulnerable persons. My daughter's car is one of her safe spaces and she relies on it totally for school runs, doctors and any other trips to avoid triggering her anxiety.

Before trying to locate all tickets and post, is there anything I can do to convince the council to take back the various cases from the two bailiffs. One bailiff has been reasonable, but will not be forever.

I know some tickets are from the same place that I have had a ticket and the advice on here is that as there was no signage at the start of the road there is no contravention, but prior to that in the previous access road is another sign prohibiting traffic which is more important, but council don't refer to that. Although there are several all over the place, which could be when she panics she will pull over and breathe, or just park as close to where she needs to be to avoid any anxiety getting in and out of where she's going, but until I have them all I cannot post full info.

Any thoughts at this stage much appreciated.

Do they have time limits for replies? I didn’t know? I’m glad they were late as I’ve been moving and I’m in so much pain I can hardly think, although I can hardly think straight on a good day! 😂. Just to add to my distress, I parked in Iceland car park (nearest) paid my pound, didn’t refund at till as I was delayed due to spasms of pain, I had to sit & take pain relief before returning to car, unbeknownst to me I was 12 mins over & they’ve sent me a ticket too! 🤯

that length of delay would appear unreasonable

No fingers crossed at all. It's the law.

Now, whether Worthing are now up to speed on the law I don't know. My only interactions were 2-3 years ago for my daughter-in-law. We won both and got costs awarded against them for the second.

At that time their obdurance was matched by their ignorance.

Let's see how they treat you.

If they play silly b*****s then, as I make frequent trips to Worthing and I'm retired with time on my hands(at least outside school holidays), I might just observe the conflicting situation within that zone(which might be repeated elsewhere for all we know) and write to them. But not until your* PCN has been determined.

*- on this point, are you the registered keeper with current DVLA details.

The suggested reps are fine.

OP, you really must dig out your copy of Traffic Signs from GOV.UK, or buy a copy.

A Pedestrian Zone MUST be signed at every vehicle entrance with the prescribed form of sign. I gave you this in an earlier post(Traffic Signs Manual, Chapter 3, s6. https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/782724/traffic-signs-manual-chapter-03.pdf.

It is this form of sign which MUST be present and configured as in 6.2 page 58. ONLY THIS carries the meaning: 'Entry to and waiting in ..PZ restricted'.

The council has a serious problem, you don't.

I am challenging the PCN on the grounds that the contravention did not occur. The pedestrian zone entry signs at both ends of South Street do not have waiting restriction signs, and in the absence of yellow lines, where I waited briefly in Bath Place, the waiting/loading contravention cannot have occurred. 

I see your CEO's pictures include a waiting timeplate that purports to establish a zone but it is a repeater sign that does not repeat an initial zone entry sign that must be there to establish a zone.

I trust you will cancel this PCN owing to faulty signage and look forward to early conformation.

My grandson very kindly took photos for me of the signs entering the original pedestrian precinct of Montague St from South St, will these make a difference, because there does not appear to be any signs at the entrance into Bath Place? Even the original signs exiting the roundabout say "Except for loading" and underneath the little sign, "no loading at any time" it is all rather ambiguous?
