Bailiffs!?

Are you serious?

How does that ensue?

Can anyone else care to comment too?

My point is I have clearly said the reason,  as pointed out, in what seems a very sorry response etc.  How can this be challenged? What is the likelihood of succeeding? Is there any point?

I saw nothing obvious to alert me or if there was, it was not clear or obvious, certainly to someone who has not been down that road before!
"
So you are now liable for the £105. If no payment is made, the the council will register the debt at the Traffic Enforcement Centre, (TEC), adding £10 onto the £105, and serve an Order for Recovery. "

Would a CCJ be reached? How bad is that?

So it was in the post.

You have NO procedural alternative other than to submit representations ASP.

'Disregard' means what it says. You are asking them to exercise discretion so IMO forget all about telling them their signs aren't clear as this would be counterproductive.

Perhaps..

...I don't know why I missed the signs because in the video these seem to be quite clear. I have to apologise on two fronts: first that I committed the contravention and second that life events prevented me from submitting representations in time.

Despite this, I would ask the authority to consider exercising discretion confident that the deterrent purpose of penalty charges has had its effect...(assuming you have a hitherto unblemished PCN record with the council!)

I am really rather livid with this now.

Having submitted "reps" in line with what you said, I got a response letter saying "you cannot appeal as a charge cert. has been issued, you have no further right to appeal"

"you now have 14 days from the date of this letter (13 Aug) to make payment of £105 for the PCN before the debt becomes eligible for registration with the county court" So the "deadline" appears to be the 27 Aug.

We can get a man to the moon but cant rescind a damn "fine" for a genuine mistake on a road which wasnt clear in the slightest to me otherwise I would not have proceeded down it!

I have questions:
What will happen on the 27th?
What happens if I don't pay by then?
What does registration with the county court mean? How long does that take?
What typically would happen?

What are my options here please?

Whilst I have had an auto generated email saying my rep was submitted I am yet to get any response whatsoever - we are now 6 days in from that?

Typically how long for them to reply?
Are they obliged to now I sent in my Rep after I got a cert charge?

Thanks.

Has anyone else also got any opinions here?

You can normally make representations online.

However it seems as though the amount has already increased to £105 and the charge certificate is on the way.

It's hard to see any representation succeeding in any event. There were a pair of no vehicles signs completely unobscured you drove straight past.

I am looking to your experts how and if there is a way to challenge/avoid this and IF so what I am saying on the online portal?

I have now received a charge cert. - issue of notice 7/8/24 "payable" within 14 days of that notice, £105.

Any help most appreciated.

There's no point arguing about the signs at the stage you are at. At the moment, by not submitting reps within the 28 day period, you have lost the legal right to submit. You can submit some now, and admit they are late and say why.If they decline to accept your reps there is not much you can do other than pay the amount demanded in in their letter of refusal to accept the reps.

Sorry, but there's no point in beating about the bush, if you do not submit reps asap, you'll get a Charge Certificate increasing the amount to £105. You cannot submit reps then at all.

thank you.

Can you now help me with      "You can submit some now, and admit they are late and say why.If they decline to accept your reps there is not much you can do other than pay the amount demanded in in their letter of refusal to accept the reps."

Because any representations made late may be disregarded, however, councils often exercise discretion before they increase the penalty charge by the statutory 50%.

Yours has been increased by 50% already -£70 is now £105- so you should be receiving a charge certificate very soon, possibly today. 'Probably' stems from not knowing the dates of the contravention (which was 1 July) and of issue of the PCN - which we still don't know.

The photos online show clear signs prohibiting all vehicles except buses.

Is it "clear" though? I'd argue not, if it was clear I would not have driven down the road.

PCN date 5th July, but you haven't explained wny you have never sent in any representations. You can submit them, but the council are under no obligation to accept them, but might do if you have a good reason. At the moment, you're liable for £105. A lot of money for ignoring a PCN, if that's what you have done.

Circumstances, travelling, hence the late dealing with this.

Advice on what to do at this stage please.

thanks

So what are now my options all?

The issue date of the PCN is above, no?

OP, you're probably too late to do anything other than pay if this is correct:

I have passed the "28 day period from the date of this notice on the letter" so urgent help please.

Your priority must be to tell us the date of issue of the PCN, you don't need to upload anything, just post. In fact just post the PCN number and your VRM and we can look online at the PCN progress.

If you're outside the 28-day period you could still make representations but these may be disregarded.

Please elaborate when you say "probably" - what is everyone elses opinion?

Hello

I have received a PCN from a borough council and need urgent help please.

I have "contravened" something by driving to the traffic lights from a 20ft road.

The details on their portal says " A PCN issued with code 52j is issued following the contravention Failing to comply with a prohibition on certain types of vehicle"

I have passed the "28 day period from the date of this notice on the letter" so urgent help please.

I have added the jpeg, but it says something "The upload folder is full. Please try a smaller file and/or contact an administrator." its only 500kb. I am not techie enough to do the other image thing you mention.

Please advise.

thanks
