I am already at tribunal stage. I have the rejection for the NTO and windscreen PCN but cannot locate my challenges or the NTO.

What happened was, I parked on a double yellow with my wife. Although a blue badge holder, I did not realise there were curb restrictions also. My wife 2 days prior was given a prognosis of months following progression of her cancer at age 30. We decided to go out for a meal and so i parked nearby as her mobility is very poor and requires a wheelchair. Not saying this allows us to park there, but I didn't think at the time with faffing around with the wheelchair and general situation. This was my challenge.

It was rejected. In my NTO challenge, I stated that the windscreen PCN do not properly conform to regulation 9 penalty charge notice requirements, https://www.legislation.gov.uk/uksi/2022/576/regulation/3, 3(1)(c): that if a notice to owner is served despite the representations mentioned in sub-paragraph (b), representations against the penalty charge must be made to the enforcement authority in the form and manner and at the time specified in the notice to owner. The pcn says:

"If the penalty charge is not paid before the end of the period of 28 days beginning with the date on which this penalty charge notice was served, a notice to owner may be served by the enforcement authority on the owner of the vehicle. A person whom a notice to owner is served will be entitled to make representations to the enforcement authority against the penalty charge and may appeal to an adjudicator if those representations are rejected.

Once a notice to owner has been served, representations must be made in the form, manner, and time specified on the notice to owner."

This was also rejected, stating the wording is there. I am not sure I agree that the PCN contains the wording "despite representations mentioned in sub-paragraph (b)" (I know it doesn't need to be exactly that but something along those lines).

I am correct or wrong here?


Another issue I have seen is I cannot access the ticket details via Redbridge which includes the photographic evidence. For the tribunal case, there is nothing uploaded yet as the tribunal is in December.

We messed up. After submitting the pe3 forms, we got this letter for 3 of them:

I write with reference to your Witness Statement which was filed with the Traffic Enforcement Centre (TEC) under ground 3 that you appealed against the Local authority's decision to reject my representaions within 28 days of service of the rejection notice but had no response to your appeal.
In light of the TEC revoking order I am writing to explain that we have no record of your appeal to the adjudicator. In order for us to consider this matter further, please provide your appeal that you have referred to in your witness statement to TEC, within 21 days of this Ietter. You can also email it to ParkingComplianceRec@richmondandwandsworth.gov.uk.

Once received we will refer your appeal to the adjudication service with an application payment of the PCN at £136:00 which may also include costs.

Should you fail to provide the appeal as requested above, we will refer your witness statement to the adijudication service with an application payment of the PCN at the charge certificate amount (£195.00).

We were meant to tick boxes 2, not 3. Not sure what to do now? Desperately need some input.

Also find it super odd where they say "alternatively I will..." rather than "We"

This is so annoying, the forms were rejected. Reason: You have not completed both forms. Please complete the attached both forms PE2 and PE3 and return both forms together.

We do not keep invalid applications. Please return all appeal forms together, along with any supporting documents/evidence.

I was under the assumption only pe3 needs to be completed and PE2 for ones outside the 21 day limit?

Finally some update but really need some advice.

They sent the order of recovery for 3 of them.

I submitted TE9 forms but it was rejected as I apparently need to send PE2 and pe3 forms which require a witness from a solicitor or officer of the court!

Why these forms instead of the TE9? This is very time consuming and solicitors are asking for £15 per form.

And my uncle is out of the country! We're already past the 21 day mark for one of the tickets.

I have asked my friend to send his appeal and rejection.

Is being fair good enough? The whole not freezing the discount period seems unfair already but wouldn't be a valid argument I think.

I can only really say they advised my friend to re-appeal only to give the same rejection, emphasising the discount period is not paused, but then what was the point of the enforcement team advising him to re-appeal. But this seems weak.

Regardless, it's gone to tribunal already (no hearing yet).

Friend forgot to pay CAZ fee and received a PCN. He appealed (no real grounds to be honest) and it was rejected.

A bit annoying with Birmingham but they do not pause the discount period. My friend received the rejection on 09/04, but it went to spam and he didn't see it until 10/04. 09/04 was the last day to pay the discounted. He also received the physical letter on 13/04.

He gave enforcement team a ring who said to appeal again and attach evidence that it was in spam.

This was rejected again but the reasons just cited the same as before, and made no reference to the email going to spam or that he was advised by the enforcement team to re appeal.

Since they won't re-offer the discount he is taking it to tribunal.

His defense is quite weak, not much to go on, but I am wondering if ignoring the second appeal and the fact the enforcement team advised him to do the re-appeal will help? I mean he'd be fine to pay the discount at least.

They still have not registered the PCNs.

I also have my own PCN with Dagenham where I received a charge certificate in mid Jan 2025 due to not receiving the NTK - I am waiting for this to be registered as well. Despite contacting Dagenham council asking them to register it (they said it will be), nothing has happened.

I don't think this is consistent advice.

When I had the same issue with LBBD, it just showed as unable to pay rather than increase the fine by £10.

Additionally with the Wandsworth charge it says it will increase by £8.

I don't think it is reasonable that I should be checking every day/week for the foreseeable future until they decide to register the charge.

Is there no time limit for them to register it? I mean if not then fine I can't do anything.

How long do we have to wait for the council to register the pcns? I have sent Te9 forms multiple times to be on the safe side but they have been rejected due to not being registered. It has been 2 months since receiving the last correspondance and 4 months since receiving the charge certificates.

I am insured on my mum's car. I received a NIP, specifically in my name, but I was not the driver at the time (it was my brother who is also insured) nor am I the RK.

I don't see why this is being sent to me and not the RK? Is this even valid?

It is concerning that the previous letter from Wandsworth gave 28 days from Jan 16th to make payment but then this recovery letter is dated on Jan 21st. On the payment for the pcn, it still shows as £65.

And to clarify, they want 65 for each PCN (while the discount period is active)
