If/when you receive a Letter of Claim (LoC), there will be more to do. Never, ever, enter into communication with a powerless debt collector.

The archive footage states that there wasn't a NTD.

If this is correct, then OP pl don't clutter the thread with what ifs and hypothetical scenarios..sorry to be harsh.

They can issue a LoC and commence proceedings if they want...and waste their time and money thereby.

They may not by law hold you liable for the driver's liability because objectively they have not met the legal conditions for doing so.

End of.

Don't argue or debate outside court, wait for your moment in court if they're foolish enough to continue. 

Just follow procedure if they pursue.
That's correct. First correspondence from Alliance parking was a NtK issued 1st November 2021. Excuse my ignorance, what is LoC sorry?

You can safely ignore anything from Trace. They are a powerless debt collector and the only thing that can actually do is to try and make the low-hanging fruit on the gullible tree pay up out of ignorance and fear.

As long as the initial appeal was made by the Keeper and the driver was not identified, there is nothing they can do about this. That does not mean that they won't try and litigate this. However, it would never be allowed to get as far as a hearing if your facts are correct.

If the alleged contravention was on 25th August 2021, the initial Notice to Keeper (NtK) must have been issued no later than 6th September. If the date of the original (reminders do not count) NtK was 1st November 2021, then there can be no Keeper liability.

Was this issued as postal NtK or was there a windscreen Notice to Driver (NtD)?

Yes the attachment in the archived forum post was the initial notice to keeper that was received. On the basis that NtK must have been issued no later than 6th September but it was issued 1st November can I just ignore this then?

Hi,

This is a continuation of the discussion that started on the old forums.

Summary:
Date of parking: 25.08.2021
Date of PCN: 01.11.2021
Date of response 25.11.2021

So on 25.11.2021 I (registered keeper) responded to the PCN by giving them the drivers version of events and also supporting evidence that I was not the driver.

I have had no correspondence from them until I received the attached. Seems they have passed this on to a debt collections agency.

Have I exhausted all avenues of appeal at this point?

I am just wondering if the old version of this forum has been archived anywhere? And if old discussions are viewable anywhere? I am certain the good people of this community helped me with a PCN back in 2021 and I need to find the discussion.

I think all you have is a polite ask that you did buy a ticket and they could kindly check their records - do you have an idea why you didn't put the ticket in your car?

The bay seems to have a parking sign although in 2022 the P was covered by a sticker. The machine instructions are clear. Good clear shots by the CEO.

I was told they inserted the money and pressed the button but got distracted and completely forgot to take the ticket out the machine. Then they just went on their way.

Did the parking ticket machine require entry of the vehicle reg number ? If so there will be an audit trail, (or should be !!).
Unfortunately it's one of those where you pay for a period of time and just put the ticket/voucher on your dashboard.

You may just have a plea that you did buy a ticket and they can check machine logs but Liverpool is not a forgiving authority. If the contravention had been parked without paying you'd have stronger grounds but it's not displaying a valid ticket.
Thanks for getting back to me. Problem is anyone could have come and purchased tickets between this payment and the PCN being issued

Might just be one I have to accept defeat on.

Hi,

A long shot this one.

Driver paid cash at machine and then stupidly forgot to actually take the ticket out of it before leaving the area.

Also didn't tell me about it until after the 14 day discount period!

Any grounds for appeal at all?

A win is a win. I know that location well. Signage is rubbish too. At least CELs in-house legal dept know that they don't have a leg to stand on if they issue a non-PoFA complaint NtK and the keeper refuses to identify the driver.

Next time I'm home, I'll try and get one myself just to prove there point.
Yeah its not clear at all where the KFC parking starts and the rest end! Not to mention the ANPR didn't even register me coming and going between the times on the PCN!

I just went with what DWMB2 said word for word but substituted in my car reg and PCN reference.

Yes I simply meant which way to appeal i.e phone, letter or online.

I did it online in the end. There was a yes / no button asking if I was the driver of which I selected no.

I was expecting them to make it sneaky but it was quite prominent during the process.
