Private parking tickets / Nationwide Parking Control PCN - London

I'm posting on behalf of a friend who received a PCN from Nationwide Parking Control. They are the registered owner of a vehicle that was parked briefly on an area adjacent to a service station forecourt last November. The driver parked to use the launderette on site but finding it was busy drove away again.

They subsequently appealed but the content of this appeal has been lost. Presumably NPC have it but the registered owner has not requested it from them.

The appeal was rejected by NPC. This is the rejection letter:

The registered keeper has now received a letter from a debt collection agency claiming a total amount of £170. I've told them to ignore this and any subsequent debt collection letters.

Looking through the information provided I've noticed a number of issues:

1. The PCN contains inconsistencies. It claims the term "No Parking or Waiting at any Time" has been breached. However the sign shown in the corner of one of the images states "No Parking Zone"
2. The PCN refers to an observation time of 51 seconds but the images show a time period of 15 seconds.
3. The signage on the site is inconsistent referring both to "No parking" and "No parking or waiting at any time"
4. There is no entrance signage.
5. There is no ANPR signage at the entrance or visible from all points
6. The appeal letter introduces a new term "no stopping" but there is no evidence of security or safety grounds.
7. The claimed observation period is less than the Consideration Period or the Grace Period
8. Parking, waiting and stopping are required to use the facilities on the land - an inpost locker, petrol pumps, air and water supplies and a launderette. Permission is therefore implied and prohibition would be an unfair contract term.
9. The appeal letter refers to different prohibitions at different locations on the site but there is no delineating signage or surface markings to show this.

The registered keeper is happy to write back to NPC telling them to drop their claim citing some or all of the grounds above. Are there any pitfalls in doing so at this stage or is it better to wait for a letter of claim? 

Any advice would be greatly appreciated.

Unfortunately the registered keeper is not sure whether the driver has been disclosed or not as they are unable to recall the content of the first appeal.

The PCN has been cancelled. No reason was given in the response other than "I have carefully considered your case and the points you have made". Thanks for all your help.

Yes I was planning to make an informal representation to start with. I can see that Enfield’s website says “The first 45 minutes are free of charge Monday to Friday by …getting a ticket from the machines located at the car parks” but this is not mentioned on any of the signs or even on the one machine hidden in the corner of the car park. I'm wondering whether, as the signage doesn't state a ticket needs to be displayed, the contravention should have been 85 - Parked without a valid virtual permit or clearly displaying a valid physical permit where required (Mrs Lydia Russo - v - Plymouth City Councilhttps://drive.google.com/file/d/1WW83Desv43qE8aviq2wez1KRsivNCqME/view.)

I've been issued with a PCN for parking in the Lodge Drive Car Park in Enfield whilst not displaying a ticket, voucher or parking clock.

When I arrived at the car park I saw a large notice which stated that in designated bays parking was free for 45 minutes. It's not clear on the sign what the process is for the 45 minutes free parking but my first impression was that it seemed a code needed to be used on the Pay by Phone app.

I then parked in a designated bay and found a sign in front of it stating that a code 080653 could be texted to 65565 to register the free parking. My Pay by Phone app had expired an needed to be updated so I chose the text option.

I sent the text immediately at 13:41 and started to walk out of the car park. Whilst walking I recieved a text response that my message was not in the correct format and that I needed to supply the vehicle registration number, parking duration and cvv number etc. I did not have my bank card on me but did text the registration number to see if that would work. Unfortunately it didn't so, as I did not have the cvv number of my bank card, I returned to my vehicle.

In the intervening period (7 minutes) I was issued with a PCN Code 83.

I explained to the CEO what had happened and he said that I should have picked up a free ticket from the ticket machine. This machine was in the far corner of the car park with no visible signage and well away from the entrance.

The CEO said I could also have used a parking clock and I did have one in my car. But as there there was no intructions on the signage in the car park explaining that was a possibility I did not think to use it.

Any advice on how to proceed would be greatly appreciated. Aside from the confusing processes and signeage I was wondering if the 10 minute rule would apply here?

I'd say wait for the notice to owner and we'll help draft something for you. You might want to redact your postal address from the rejection letter.

Also please post up a copy of your informal representation.

Will they reissue the discount at NTO stage? Mrmustard has already told me it's a tricky one without the original PCN as the contravention occurred and the only defence would be on technical grounds.

The informal representation was simply :Unfortunately the reminder email for my residents permit went into my email spam folder. I therefore forgot to renew my residents permit. This is the first time I have forgotten to renew a permit. I have now renewed my permit online for this vehicle and it is valid from today (12/9/23).:

How can I edit an old post to redact the address? There doesn't seem to be an option to do that.

My resident's permit expired on 12/07/2023 and unfortunately I missed the email remainder from Haringey and forgot to renew it. On 12/9/23 I received a PCN for code 12r. I immediately renewed my resident's permit and made informal representations stating that this was the first time that I had forgotten to renew the permit and had previously not been issued PCNs in similar circumstances. However Haringey have rejected my informal representations (letter attached). Is it worth waiting for the NTO and appealing again and if so on what grounds? In the letter they say "Your permit was not acceptable because it had expired." so I was wondering why the PCN wasn't issued under code 19. The do sympathise which is nice  ::)  but have not cancelled the PCN.

I had exactly the same scenario in Haringey last year. The first PCN fell off my windscreen and resulted in an NTO. The second one I paid. I appealed and Haringey cancelled the first PCN.

Thank you. That's very helpful. The most annoying thing is the suspension was to carry out work which was actually done after the suspension had ended.

Yes I'm a permit holder. The PCN number is ZN07622991 and the registration LL57ZHB. I parked 34 minutes after the start of the suspension. Normally I would notice parking suspension signs but this one was partially hidden and didn't catch my eye when I parked up. I received a PCN a few weeks ago for parking in a suspended residents parking bay. I didn't notice the sign probably because it was partially hidden behind a resident's parking sign from the direction that I approached.

The Council have rejected my informal appeal on the basis that "street signs at this location are lowered because of a preservation order in place. It is for this reason that the signs are not raised on posts and more clearly visible." and that "there is still enough yellow in sight to draw your eye".

Is it worth taking this further and appealing after receiving a NTO? Any advice would be greatly appreciated. I don't want to lose the opportunity of the discount on the PCN if an appeal is unlikely to be upheld.
