The Flame Pit / Re: Have I been caught?
« on: August 29, 2025, 01:44:13 am »
What are you telling us here? That you think you went though a 50mph section at 66mph? Assuming that's what the 'average speed camera section' means, at 66mph you will be eligible for a COFP inviting you to invest £100 and receiving 3 points on your licence in exchange. At 64mph you would be eligible for a speed awareness course.

It's possible that I went through the whole section from J24 to J28 at around that speed.  I had read somewhere that it isn't necessarily treated as a single offence.

I drive this section of the M4 regularly and just got back from a long drive from Portsmouth to the Swansea area.  I had the car on cruise control before the Average speed camera section and I think I reduced the speed on that section, but can't remember setting it back to 66 in the NSL section after, though it was set at that speed well after that.  I set it on my electric car as it's a speed that gives me a decent economy to get home without having to stop to charge.  Now just wondering what the worst I can expect is - 66 on my car is nearer 64 and I have it set on adaptive assist mode.  There wasn't much traffic at all, so I suspect my speed will have been consistent.  It's therefore possible that I went through the whole section at an indicated 66...

For clarity, my licence of 12 years standing is so far clean.

I still have until end of this month to reply

Yes I know. I'm simply trying to explain that you might as well do so now. At the end of the month your response will be identical. Still, your choice.

OP has been given advise elsewhere that they should allow 14 days to elapse so there isn't time for the police to send an amended NIP with the correct location.

A new keeper has been telling porkie pies about his address, and has used your address.  I fear you have a lot of these coming your way. Further down the line it is possible you could get court bailiffs coming to your address if and when matters go to court.  So unfortunately, you may be kept fairly busy on this.

with facebook you can make audio and video calls via Messenger, so while a phone number is useful, a physical call can be made via Messenger and therefore many would accept it as a source of contact.

Not helpful for dealing with this now, but helpful for the future, does your car have a speed limiter button?  If you set that for the speed limit, you will never be caught again.

Speeding and other criminal offences / Re: S.172 reply

Thanks. Offence was 24th Dec. No personal relationship with the lease company at all, I just run the payroll/salary sacrifice within the business that leases the car from the lease company. Will wait for the S.172 to the company (which will go to our registered address first and then be forwarded by accountants!) and hope it's all in time. Confusing the sausage machine is exactly what I don't want to do.

You won't necessarily need a special relationship with leasing company to ask them to name you as an individual rather than as a company, if they haven't already submitted your company's details. It could be a simple situation of asking them if they would do it.  This won't confuse the sausage machine, whereas replying as an individual to a S172 to a company may well do so.

He is over the threshold for enforcement since it starts at 46.  It would be counted as 46 even if 46.99 mph as figures are always rounded down, not to the nearest number.  How long was it following the offence was the NIP sent?

He may well be able to ask for the sentencing to be in line with the fixed penalty level.

The failure to furnish is also a far more serious offence with 6 points minimum penalty.  You basically have to decide whether you want to pursue the fail  to furnish which is possible but often fraught with difficulties, or following the stat dec and re prosecution of both offences, do a plea bargain to accept the speeding charge if the FtF is dropped.  They nearly always oblige.

Wide angle lenses make distances look further, not closer. You get the effect of compression from long lenses.

No cameras found on this street.
This offence was man handed (unseen)
From looking at the evidence I can see vehicle is on a fairly steep road caught at 35 and soon after at 32 as driver recognised vehicle was driving faster than anticipated down the hill
Road is called hill south.
I have a bilateral knee disability which clearly affects pressure applied to pedals down a hill and my reaction times due to pain and ADHD are little slower than the average person
I feel man handled speed fine here is quite unfair can I challenge this at all to my defence as having some disability adjustments?
Also it’s evident I did slow down immediately after being pulled faster down hill.
Surely they have chosen this spot to advantage themselves for giving fines and penalties?
Any other people shared useful helpful info about this specific location?
Driver is myself with both mental and physical conditions- all details have been now fully reflected on and gathered and I’m now considering whether to challenge this on man handed location unfairness and the fact I did slow down without knowledge of any cameras or man.
If there is a way to defend this I’d like to try as I would like to avoid points

I’ll post pictures

You can avoid points by taking the course.

If your conditions affect your ability to drive within limits then it will be a notifiable condition to DVLA and your ability to drive may be withdrawn until such time that you are free of those conditions.  For this reason, I suggest not trying that as mediation or defence.

Just take the course and drive a little slower than the speed limit so that you can be in the new speed limit at the post.

An IN10 showing on your driving record will also stop most mainstream car rental companies renting a car to you.

Have you done an awareness course in the last three years for the same kind of offence?  If so, you won't qualify.
