Hello all,
I rented a van in August and it appears that I drove into a bus lane. The hire company had an old address on file for me (I've been hiring from them for many years) which does not match the address on my drivers license. A friend of mine still lives in the building of my old address, and by chance saw a letter addressed to me and gave it to me this week.

Can I appeal this on the grounds that it was sent to the wrong address? Failing that, can I appeal on the grounds that it was sent out two months after the contravention? A quick Google search seems to indicate that it needs to be sent out within 28 days 'in most cases'. Is this true for a simple bus lane ticket? Does the fact that it was a rental change things?

If I can't appeal on the grounds that it was sent out late, can I ask to pay the £35 reduced rate, citing that it was sent to the wrong address and that I only saw it this week?

I have a privately owned van (VW transporter SWB low roof) which is for personal use. It has signage for a removals company I used to run, and I have left the signage even though the company no longer exists.
I have received a good number of fines from Bradford Council in the last couple of years, and I have just seen that private car users are exempt.

Please could people advice if I am liable, and if I am not, how can I let them know that the van is for personal use only?

Also, if I am not liable, what are my chances of claiming back the fines?

Did you use your vehicle in London and can therefore evidence paying the London emissions charge?

Thanks for your responses. When you say in (second) that they would need to see some collateral, do you mean evidence that I was away? I can provide my contract from a theatre in London and 8 weekly paid invoices.

Hello all,
I returned home after two months away to find a PCN and Charge Certificate (attached).

My first question: is it lawful to demand a penalty charge of £120 PLUS the original £9 ULEZ fee?

Second: Is there any way I can present the fact that I was away (which I can evidence) in an appeal, or will they just say that I should have had someone checking my mail for me?

Third: The reason I was in Bradford in the first place was that I was performing in a band, unpaid, for a charity gig. It was also my first time driving in Bradford since the ULEZ came in and I was unaware that it existed. I didn't see any signs because I was concentrating on my driving. Are any of these facts worth including in my appeal? I spoke to someone from Bradford Council on the phone and they told me that they might reduce the fee based on my presenting this information, but my experience with appeals is that unless I have open and shut grounds for appeal, I will get a smart and resounding NO in response to my appeal.

Any input on this, or other thoughts on how I might challenge this, would be much appreciated this.

I was not loading. I was under the impression that the parking regulation had been suspended, and that was why it had been painted over.

Is it fair to expect us to understand that a sign is still in force when, whilst legible, it is covered in paint?

Hello all,
I recently received a parking ticket with contravention code 25, 'Parking in a loading bay during restricted hours without loading'. Location was High Street, Waltham Cross, Borough of Broxbourne.

However, the signage was clearly inadequate in that it had been sprayed over and was unreadable. See attached. This was the only sign pertaining to this space.

I am guessing that this would be a simple appeal on the grounds of inadequate signage, however I am keen to hear people's input.

Hello all,
I have received a Notice to Keeper (attached). The NTK states that the vehicle was parked without anyone having purchased a ticket within the time allowed.

On the day in question, the driver did purchase a ticket, but they stayed longer than the time paid for.

I sent an appeal to Excel's internal portal, explaining that as the keeper I am not responsible for the actions of the driver in this regard, that I have told the driver that Excel have been in touch and that Excel would like the driver to contact them, and that whether or not the driver did indeed contact Excel was up to the driver.

I will add an image of the signage on Tuesday.

Excel wrote back (attached) and now I am wondering what my next move is. My understanding is that we need to appeal to the company's internal appeals system, which will always reject, and then take it to an impartial third party.

Any help with this would be massively appreciated.
