So I submitted a formal rep with the below:

2. I also consider the white line to be faint and not fit for purpose.

3. I was forced to manoeuvre into bus lane as the vehicle in front braked suddenly as I was turning left onto the main road.

4. I put you to strict proof that the camera used is approved. If you cannot provide this, the evidence is inadmissible.

I also refer you to PCN PN75156509 which was cancelled.

In light of the above, please cancel the said PCN.

I received a rejection letter fairly quickly:




Frustrated by the inconsistency as the other PCN posted by another member on here was cancelled for the same alleged offence.

Finally received the Enforcement Notice in the post. Since receiving the rejection to my informal appeal, I see that another member also received a PCN for the same alleged offence and appealed and won. The inconsistency is frustrating to say the least! They had the same points that I put down in my appeal.

Hi all, just an update on this one. My neighbour had his hearing and won. Think it was based on the observation time being only 3 minutes and not sufficient enough in this case.

My neighbour is grateful for everyone's help and advice to win the case  :)

Amazing, thanks for the help. I can confirm there is no signs on the side road relating to the bus lane

So there is a bus lane sign on the corner where the side and main road meet, you can see it in the left corner of the video.

Hi everyone, looking for some help in appealing this one. I was expecting it as soon as I realised what I had done on the day.

So allow me to explain what happened, I was driving out of the the road that I live on, onto the main road Romford Road. There was a vehicle driving in the direction that I was intending to travel in, I allowed it to pass and pulled out behind the vehicle. As I was pulling out onto the main road the vehicle in front was braking a lot sooner than I had anticipated, so I instinctively pulled in to the bus lane to avoid having to brake hard. As I was turning left at the next junction, I stayed in the bus lane. The distance between me entering the bus lane and the end of the bus lane is roughly 100 yards.

Now i'm not expecting Newham to believe my version of events, so i'm hoping I am able to appeal on any technicalities. Please help :)

Sorry I was speaking on behalf of my neighbour. Spoke to him just now and he is refusing to pay and wants to take this to adjudicators (Although did warn him there is no guarantee he will win may end up having to pay more than the discounted amount!).

Received the notice of rejection this morning  :-[

Any help on how to proceed with this, they didn't even acknowledge the fact that I was boarding a disabled passenger!

While having a moan with my neighbour about the unfair CEOs in our area, he mentioned he too has been a victim of their behaviour. He has already submitted an informal challenge which has been rejected and received a NTO today. He wanted some advice on how to proceed so I mentioned the helpful people here might be able to assist.

I've asked him to dig out the original PCN so will upload that when I have it. This is the informal rep that he made:

Dear Sir/Madam
I write to you in respect of the above Penalty Charge Notice issued to my vehicle on Sunday 03rd March 2024.
 
I have been a resident on this road for 34 years, and have had a resident’s permit since the introduction of the CPZ and on the day of the penalty charge. I am well aware of the restrictions on the road that I live on and on this particular occasion I had intentionally moved my car forward to the drop kerb opposite my next door neighbour’s driveway to facilitate the transfer of my disabled father in law who had been staying with us into the vehicle. There is no other reason for me to park on the double yellow line where there was plenty of parking space available in the marked bays at the time the alleged contravention occurred.
 
I had left the hazard lights on which the CEO failed to observe, and momentarily re-entered the house to assist my father in law who is wheel chair bound, and upon returning to the vehicle a few minutes later saw the PCN had been issued. He had in his possession his blue badge which would have allowed him to have the vehicle parked there for 3 hours, however as we were merely loading passengers we did not feel it was necessary and the increased risk of having the badge stolen with the car unlocked and unattended. Please find attached a copy of the badge.
 
We would greatly appreciate if the above can be taken into consideration in reviewing this PCN.

So i received a rejection letter by email on 19th April, following my informal challenge on 21st March:




I had my laptop stolen so don't have a copy of the challenge that I made, would I be able to request this from the Council?

But I basically made the points above, and provided a copy of the permit receipt. Still waiting for the NTO to come through the post.
