Dear Sir/Madam,
I am writing to formally challenge the above Penalty Charge Notice issued for an alleged contravention at the yellow box junction on Chingford Road at 15:12.09.
At the time, I was turning right from Brettenham Road onto Chingford Road, which itself has a yellow box junction, and the second yellow box on Chingford Road/Brookscroft appears within just a few metres of completing the turn. This extremely short distance offers little time to react or assess downstream traffic conditions, particularly when visibility is compromised.
In this case, the traffic light on the left side of the main road was heavily obscured by trees, and the car ahead of me was travelling quickly. I thus had no reason to believe the lights had changed or that traffic would suddenly halt. As I completed my turn and entered the box, the vehicle ahead began braking while I was already inside the yellow box, leaving me momentarily caught behind it.
I brought my vehicle as close as safely possible to the car ahead, but due to the size of my car, the rear portion of my car remained just slightly within the yellow box. However, at no point was I blocking or impeding the flow of any other vehicles, allowing cars to turn in and from Brookscroft to Chingford Road and vice versa. I understand the purpose of a yellow box junction is to prevent obstruction—this was not the case in my situation.
Furthermore, I was physically unable to reverse and clear the box as there was a cyclist exiting Brookscroft road in the yellow box already and a car had pulled up closely behind me on the opposite side of the box.
This made reversing unsafe and impractical, leaving me with no option but to wait a few seconds until the traffic began moving again at 15:12:15—a delay of only 6 seconds, during which I caused no disruption or hazard.
Given the combination of poor visibility, the close proximity of back-to-back junctions, the behaviour of the car in front, and the lack of obstruction caused, I believe this PCN was issued under circumstances that fall outside the intended spirit of enforcement. I kindly request that the penalty be reconsidered and cancelled accordingly.
